�विभ& न �कार के टोनर काटेजो/इंक काटेजो क आपूित के िलए वा�षक दर पर ठेका देना चाहता

है *जसके िलये िन�वदा आमं�+त करने जा रहा है। टोनर काटेजो क खर.द ितमाह. आधार पर

क जायेगी । हमार. आव1 यकता के आधार पर मा+ा बढ या घट सकती है। एक वष के िलए

एच पी िनिमत ��ंटरो के िलये टोनर काटेजो क सभी टाईप क �ाि5 का कुल आर*%त खचा

7पये 22 लाख होगा । 7िच रखने वाली एच पी �िधकरत फम जो �े:डट आधार पर अनुल< न ग म= :दये गये

पू*> ववरण के अनुसार सभी �कार के एच पी िनिमत टोनरो क आपूित करने के इ@ छुक है ।

अपनी दरB को सील बंद िलफाफB पर “एच पी िनिमत ��ंटरो के िलये टोनरो क आपूित के िलए

दर सूची” िलखकर भारतीय मानक # यूरो 9 बहादरु शाह जफर माग नई :दE ली-११०००२ पर 18

:दस� बर 2012 को १५०० बजे तक भेज सकते है *जसे 7िच रखने वाले बोली दाता या उनके

�ितिन िधयB क उप*Nथित म= उसी :दन १५३० बजे कमरा नं ४०६ मानकालय म= खोला जाएगा

�विध व त िन�वदा �लेख को कमरा नं ४०६ मानकालय भारतीय मानक # यूरो 9 बहादरु शाह जफर

माग नई :दE ली-११०००२ के िन�वदा बॉT स म= डाली जा सकती है। टोनर काटेजो क अलग रािश का बयाना (ई एम ड.) 7पये 50,000.00 बVक Wाफट के 7प

म= भारतीय मानक # यूरो नई :दE ली को िन�वदा के साथ भेजा जाये। बयाने क रािश

ठेके के अंितमकरण के बाद असफल िन�वदा को वा �पस भेजी जाएगी। सफल िन�वदा को 7पये

1,00,000.00 क को िनX पादन सुर%ा रािश जमा करवानी होगी। जो ठेके क अविY के िलए बैक

गारंट./:फT स जमा के 7प म= �Z येक वN तुओं के िलए अलग से होगी। िनX पादन रािश को

िन�वदा के िनंबधन और शत] के :क& ह. उE लंघन होने पर या पाया जाता है :क आपूित :क◌ेये

गये एच पी िनिमत ��टंरो के िलए टोनर क गुणता अ@ छ_ नह. है तो ज# त का :दया जायेगा । िन�वदा �लेखो के अनुल< नक I, II, ओर III म= यो< यता कसौट. िनबंधन और शतa द. गई

1 िन�वदा �लेख के अनुल< नक III म= दशाये अनुसार एच पी िनिमत ��ंटरो के िलये

टोनर क आपूित के िलए मौहर बंद िन�वदा आमं�+त क जाती है । टोनर काटेजो

क खर.द ितमाह. आधार पर क जायेगी।

2 मौहर बंद िलफाफे म= *जस पर “एच पी िनिमत ��ंटरो के िलये टोनर आपूित के िलए

दर सूची” िलखा हो क िनदेशक (�शासन) को 18 :दस� बर 2012 के 1500 बजे तक

भेजा जा सकता है *जसे उसी :दन 1530 बजे कमरा न0 406 मानकालय म=

िन�वदाकारB या उनके gारा �विधवत �ािधकृत �ितिनिधयB के सामने खोला जाएगा ।

सभी दर सूिचयां उनक खुलने क ितिथ से 90 :दनB क अविध तक N वीकायता के

िलए खुली रह=गी ।

3 िन�वदाकारB से अपे%ा क जाती है :क अपनी िन�वदा को बयाने के 7प म= “भारतीय

मानक # यूरो” नई :दE ली पर देय के प% म= 7पये 50,000.00 :क रािश के :डमांड

Wाiट के साथ भेज द= । *जसको असफल िन�वदाकारB के उनके िल*खत अनुरोध पर

वापस कर द. जाएगी । फम का नाम दरूभाष सं0 और वN तु का नाम :डमांड Wाiट

के पीछे िलखा जा सकता है । अगर सफल िन�वदाकार भारतीय मानक # यूरो क

अपे%ा के अनुसार िनधाjरत अविध म= माल क आपूित करने म= असफल हुए तो

उनका बयाना ज# त कर िलया जाएगा ।

4 भुगतान सामा&यतः अनुमो:दत नमूने/�विशX ट के अनुसार पूण आपूित क �ाि5 एवं

N वीकृित के बाद �बल के �N तुत करने क ितिथ से 30 :दनB म= कर :दया जाता है ।

5 उT त वN तुओं के सुपुदगी �य आदेश के जार. करने के 15 :दनB क अविध के भीतर

अपे*%त है । िनयत अविध के भीतर माल क आपूित न करने पर :डफाE ट के

मामल े म= आदेश के मान क 5% तक पेनE ट. क जा सकती है । सामmी क

सुपुदगी हमार. जार. N टोर मानक भवन 9 बहादरुशाह जफर माग नई :दE ली 110002

पर क जाएगी । अपूण दर सूची को अN वीकृत :कया जाएगा ।

6 द. गई दरB म= सभी �भार जैसा :क पV:कग और �े%ण, भाड़ा, बीमा, चुगीं आ:द

स*�मिलत हV ।

7 अगर द. गई दरB म= वैट या अ& य कर, �भार शािमल नह.ं है तो उसी को �वशेष 7प

से अं:कत :कया जाएगा । इनम= से :कसी क अनुप*Nथित म= यह माना जाएगा :क

क़ मतB म= सभी ऐसे �भार शािमल हV तथा उनके िलए भ�वX य म= :कसी दावे पर

�वचार नह.ं :कया जाएगा ।

8 सभी सामान क �ाr ती िनर.%ण पर अनुमोदन के अधीन होगी । िनjर%ण करने वाले

अिधकार. का िनणय बाs यकार. होगी । अN वीकृत वN तुओं को आपूित कता gारा इन

सामानB को हटाने के नो:टस के जार. करने के 10 :दनB के भीतर उसे अपने खचt

और जो*खम पर हटाया जाएगा तथा अN वीकृत/ अनुमो:दत सामान वN तुओं /सामmी

के # यूरो पर कोई देयता जो कुछ भी हो नह.ं होगी ।

9 # यूरो के पास दर सूची सूिचयां को पूण या मा+ा के :कसी अंश को N वीकार करने

का अिधकार तथा सफल िन�वदाकार द. गई दर सूची के अनुसार आपूित करे ।

10 # यूरो दर सूची को N वीकृत या :कसी या सभी को पू> 7 प से �बना कोई कारण बताये

जो कोई भी हो अN वीकृत कर सकता है ।

11 # यूरो �वलंब, %ित या �े%ण के बाद दर सूिचयB के न �ाr त होने क कोई *ज� मेदार.

12 ठेके के अनुपालन के न करने के मामले म= # यूरो के पास आदेश को िनरN त/ रu

करने का अिधकार है ।

13 :कसी �ववाद या भेद के मामले म=, उसे उप महा िनदेशक (�शासन) भारतीय मानक

# यूरो नई :दE ली gारा िनयुT त एवं पूण �ववाचक gारा �ववाचन के संदभ म= िनबटाया

जाएगा । �ववाचन और समझौता अिधिनयम 1996 के �ावधान लागू हBगे ।

14 �लेख के :कसी खंड के w यवसाय या िनवाचन से उठने वाले :कसी �ववाद के मामले

म= केवल :दE ली क & यायालय को �यZ न करने और िनणय लेने का %े+ािधकार होगा

।

15 अगर आपूित :कया गया माल घ:टया :कN म या अनुमो:दत नमूने के अनुसार नह.ं

पाया जाता है, भारतीय मानक # यूरो के पास माल को अN वीकृ त करने का अिधकार

है ।

16 दर सूची के साथ वैट (क मत जुड़ाकर) पंजीकरण �माणप+ और पेन संx या (N वयं

gारा अनु�मा*णत ) क फोटो�ित भेजी जाएगी ।

17 बयाने से छूट का दावा करने वाले बोलीदाता के अपने अनुरोध के साथ �ुफ भेज

सकता है ।

18 अगर िन�वदा खोलने क ितिथ शिनवार र�ववार या राजप�+त अवकाश पर पड़ती है

तो िन�वदा को अगले काय :दवस पर खोला जाएगा ।

19 अगर आवेदन प+ के साथ बयाने के िलए आव1 यक मूE य के ड. ड./बVकर चैक नह.ं

हV तो िन�वदा जार. करने के िलए �वचार नह.ं :कया जाएगा ।

20 इस सूचना को हमार. वेब साईट www.bis.org.in पर भी देखा जा सकता है ।

21 दर सूची खोलने क ितिथ से 90 :दन तक मा& य रहेगी । :कसी भी आधार पर मूE य

म= बढोतर. क अनुमित नह.ं द. जाएगी ।

22 आपूित क मा+ा को अिधक या कम :कया जा सकता है ।

23 फैT स या ईमेल gारा भेजी गई दर सूची पर �वचार नह.ं :कया जाएगा ।

25 एक फम क ओर से भेजी गई िन�वदा फम के सभी पाटनरB gारा हN ता%jरत हो या

एक पाटनर gारा जो �N ता�वत ठेके म= भाग लेने हेतु फम क ओर से आव1 यक

�ािधकृत हो अ& यथा िन�वदा को अN वीकृत भी :कया जा सकता है । िन�वदाकार

िन�वदा �लेख के अनुल< नक III पर उनक दरB को भेजने के िलए अपे*%त हV ।

26 िन�वदा को भरते समय क सभी काट छांट तथा पjरवतन को िन�वदाकार के

हN ता%र gारा N था�पत होनी चा:हए तथा अंकB के उपर िलखने क अनुमित नह.ं है ।

इन शतz के :कसी एक का पालन न करने पर िन�वदा आमा& य हो जाएगी । िन�वदा

को खोलने के बाद िनयम या शतz म= :कसी पjरवतन क कोई सलाह नह.ं द. जाएगी

।

27 िन�वदाकार जो �Z येक वN तु क अलग से कम से कम बोली रािश स:हत &यूनतम

अहता कसौट. को पूणकता है उसे सफलतापूण बोली दाता L1 मान िलया जाएगा ।

सफलतापूण बोलीदाता को माल एवं समझौता पर हN ता%र करने क अपे%ा क

Dear Sir, BIS intends to enter into an Annual Rate Contract for procurement of Toner Cartridge/ink cartridges for HP make printers to meet its annual requirement of different type of HP toner cartridges at BIS Hqs New Delhi. The procurement of Toner Cartridges would be made on quarterly. The quantity may be increased or decreased depending upon our need. The annual estimated expenditure for purchase of Toner Cartridges for H.P.make printers would be Rs. 22 lacs. Interested HP authorized firms who are willing to supply the HP Toner Cartridges as per the details given in Annexure-III on credit basis under Annual rate contract may quote their rates in a sealed cover superscribing the envelope “Quotation for supply of HP Toner Cartridge ” addressed to the Director (Administration), Bureau of Indian Standards, Manak Bhavan 9, Bahadur Shah Zafar Marg, New Delhi 110 002, latest by 1500h hrs , 18 December 2012 which will be opened as per procedure on the same day at 1530 hrs in Room No 406 Manakalya in the presence of interested bidders or their representatives. Duly completed tender document may be dropped in the tender box in Room No. 406, Manakalaya. BIS 9, Bahadur Shah Zafar Marg, New Delhi 110 002. An earnest money (EMD) of Rs. 50,000.00 (Rupees Fifty Thousand Only ) in the form of bank draft in favour of Bureau of Indian Standards, payable at, New Delhi may be submitted alongwith the quotation. The earnest money will be refunded to

the unsuccessful tenders after finalization of the contract. Successful tenderer will have to deposit performance security money of Rs.1,00,000.00 (Rupees One Lacs) in the shape of bank Guarantee/fixed Deposit for the period of contract. ELIGIBILITY CRITERIA AND TERMS AND CONDITIONS

1. Sealed quotations are invited for supply of different kind of HP Toner Cartridges for HP Make printers. The procurement would be made on quarterly basis.

2. Quotations in a sealed cover super scribed “quotations for the supply of HP Make Toner cartridges may be sent to The Director (Administration) latest by 1500 hrs, on 18 December 2012 and will be opened on the same day at 1530 hrs , Room No 406 Manakalya .in the presence of tenderers or their duly authorized representatives. All quotations shall remain open for acceptance for a period for 90 days from the date of opening of quotations.

3. The tenderers are required to send their tender alongwith a Demand Draft of Rs.50,000.00 (Eighty Fifty Thousand) drawn in favour of “Bureau of Indian Standards” Payable at New Delhi as Earnest Money, which will be refundable to the unsuccessful tenderers on their written request. Name of the firm telephone number and name of the item may be written on the reverse of the Demand Draft. If the successful tenderer fails to supply the goods within the stipulated period as per the requirement of the BIS his earnest money will be forfeited.

4. The payment is normally made within 30 days from the date of submission of the bill after full supply is received and accepted as per approved sample/specification.

5. The delivery of the above items is required within 15 days of issue of the purchase order. In case of default, for non supply of goods within stipulated period a penalty of upto 5% of the value of the order can be imposed. The delivery of the material will be made at our Issue Store at Manak Bhawan, 9, Bahadur Shah Zafar Marg, New Delhi 110 002. Incomplete quotations shall be liable to be rejected.

6. The rates quoted shall include all charges, such as, packing and forwarding, Freight insurance, octroi, etc.

7. If the rates quoted do not include VAT or any other tax, charges, the same should be specifically stated. In the absence of any such stipulation, it will be presumed that the prices include all such charges and no claim for the same shall be entertained later on.

8. All goods shall be received subject to approval on inspection. The decision of the inspecting officer shall be binding. Rejected items shall be removed by the supplier at his own cost and risk, within 10 days of issue of notice for the removal of such goods and no liability whatsoever, on the Bureau shall be attached for the rejected/disapproved goods items/stores.

9. The Bureau reserves the right of accepting the whole or any part of the quotation(s) or portion of the quantity offered and successful tenderer shall supply the same at the rate quoted.

10. The Bureau reserves the right to accept or reject summarily any or all quotations in whole or in part without assigning any reason whatsoever.

11. The Bureau takes no responsibility for delay, loss or non-receipt of quotation(s) after despatched

12. In case of non-compliance with the contract, the Bureau reserves the right to cancel/revoke the order.

13. In case of any dispute or differences, the same shall be settled by reference to arbitration by a sole arbitrator to be appointed by the Deputy Director General (Administration), Bureau of Indian Standards, New Delhi. The provisions of Arbitration and Conciliation Act, 1996 shall be applicable.

14. In case of any dispute arising out of the business or interpretation of any clause of the document. , the Court at Delhi alone shall have the jurisdiction to try and decide.

15. In case of goods supplied found to be of inferior quality or not according to the approved sample, BIS has the right to reject the goods.

16. Photocopy of vat (Value Added Tax) registration certificate Pan No (self attested) will be submitted alongwith the quotation.

17. The bidder claiming exemption from earnest money should forward the proof alonwith their request.

18. If the tender opening date falls on Saturday, Sunday or Gazetted Holiday the tender will open on next working day.

19. Application not accompanied by requisite value DD/Banker Cheque towards earnest money shall not be considered for issue of tender.

21. The quoted rates shall be valid for 90days from the date of opening of the quotation. No escalation in price would be permitted on any ground.

22. The quantity of supply may increase or decrease.

23. Quotation sent through fax or e-mail will not be considered.

24. Each page of the tender documents is required to be signed by the person or persons submitting the tender in token of his their having acquainted himself/them selves with the General Conditions of the contract as laid down. Any tender with any of the documents not so signed will be rejected.

25. The tender submitted on behalf of a firm shall be signed by all the partners of the firm or by a partner who has the necessary authority on behalf of the firm to enter into the proposed contract otherwise the tender is liable to be rejected. The tenderers are required to quote their rates in Annexure III of the tender document.

26. All erasures and alterations made while filling the tender must be attested by initials of the tenderer overwriting of figures is not permitted, failure to comply with either of these conditions will tender the tender void. No advice of any change in rule or conditions after the opening of the tender will be entertained.

27 The tenderer meeting the minimum eligibility criteria with the lowest bid price for each item separately shall be deemed as the successful bidder L-1. The successful bidder shall be required to sign an agreement. The draft agreement is given at Annexure IV of the tender document.

M/s……………………………………………….……………..having its registered office at……………………………………………………………..(Hereinafter referred to as “the Supplier”) which expression shall unless excluded by or repugnant to the context be deemed to include his successors, heirs, executors, administrators, representatives and assigns) of the other part for providing Toner Cartridges for HP make Printers.

I. WHEREAS BIS invited bids through open tender, vide Notice Inviting Tender No. …………….. dated …………… for “procuring Toner Cartridges for HP make Printers under Tender No……..........

II. AND WHEREAS the Supplier submitted his bid vide………………………………… in accordance with the bid documents and represented therein that it fulfills all the requirements and has resources and competence to provide the Toner Cartridges for HP make Printers to BIS.

III. AND WHEREAS the Supplier acknowledges that BIS shall enter into contracts with other Suppliers / parties for the providing Toner Cartridges for HP make Printers for its office in cases the Supplier falls into breach of the terms and conditions as stipulated in the Tender Document and shall waive its claim whatsoever in this regard.

VI. AND WHEREAS the terms and conditions of this Contract have been fully agreed on between BIS and the Supplier as parties of competent capacity and equal standing.

VII. AND WHEREAS the Supplier has fully read, understood and shall abide by all the terms and conditions as stipulated in the Tender Documents for providing Toner Cartridges for HP make Printers to BIS, failing which the Contract is liable to be terminated at any time, without assigning any reasons by BIS.

VIII. SUPPLY OF GOODS:

(i) AND WHEREAS the delivery of the items/ material mentioned in Annexure ‘C’ is required within 15 days of issue of the purchase order.

(ii) AND WHEREAS in case of default, for non supply of goods within stipulated period a penalty of upto 5% of the value of the order can be imposed.

(iii) AND WHEREAS the delivery of the material will be made at our Issue Section at Manak Bhawan, 9, Bahadur Shah Zafar Marg, New Delhi 110 002.

IX. AND WHEREAS the payment is normally made within 30 days from the date of

submission of the bill after full supply is received against the Purchase Order and accepted as per approved specification.

X. AND WHEREAS all goods shall be received subject to approval on inspection. Rejected items shall be removed by the supplier at his own cost and risk, within 10 days of issue of notice for the removal of such goods and no liability whatsoever, on the Bureau shall be attached for the rejected/disapproved goods items/stores.

XI. AND WHEREAS the Bureau reserves the right to accept the whole or any part of

the quotation(s) or portion of the quantity offered and successful tenderer shall supply the same at the rate quoted.

XII. AND WHEREAS if the supplier fails to supply the material after awarding of the contract, BIS shall be at liberty to forfeit his Performance Money.

XIII. AND WHEREAS in case of any dispute of differences, the same shall be settled by reference to Arbitration by a sole arbitrator to be appointed by the Deputy Director General (Administration), Bureau Of Indian Standards, New Delhi. The provisions of Arbitration and Conciliation Act, 1996 shall be applicable.

XIV. AND WHEREAS in case of any dispute arising out of the business or interpretation of any clause of the document, the Court at Delhi alone shall have the jurisdiction to try and decide.
