    NOTES CONCERNING COMMONLY MADE MISTAKES BY PUBLIC AUTHORITIES

    Following notes have been culled from CICs various decisions. For specific decision no./date, contact us.

    A PA can divide responsibilities among PIOs, but every PIO & APIO has to accept every application.

    PIO named in the application has to provide information. He cannot forward to another PIO internally.

    By virtue of the above and in accordance with several decisions of the CIC, information cannot beprovided to an applicant from/through various PIOs or in bits and parts. It has to be consolidated.

    Section 6(3) of the Act cannot be invoked to transfer an application within the same PA.

    Even if information is available on the website of the PA a citizen can ask for it through an application.

    No document can be classified arbitrarily as secret or confidential except as provided for in the Act.

    Section 7(9) cannot be used to refuse information. It only means that PIO can provide information in

    the available format if the requested format disproportionately diverts resources of the PA.

    Any attempt at frustrating an applicant from submitting the application invites complaint under section

    18(1). Such complaints are dealt with seriously and compensation to complainant can be awarded.

    An APIOs job is only to receive an application or an appeal and forward it to the concerned PIO orAA. He cannot be part of the process of providing information any further.

    public authority and required to comply in full with various provisions of the RTI Act 2005.

    RTI COMPLIANCE

    1. Under section 4(1)(b) of the RTI Act, you are supposed to publish/disseminate information

    under 17 heads. Please advise if you have done so.

    2. If yes, please advise the following:

    a. Dates on which the information was published/disseminated.

    b. The methods and means used to disseminate the information.

    c. Has the information been disseminated through/on your website? I have checked

    and saved every single page but found no reference to the RTI Act.

    d. Please advise the names and addresses of the PIOs and first Appellate Authorities.

    e. I would like a hard copy of the information. Please supply it.

    3. If you have not disseminated information, please advise the following:

    a. The reasons for not disseminating the information.

    b. The names, designations & addresses of the persons responsible for disseminating

    the information but who have not done so.

    c. According to rules/norms/regulations/bylaws, what action is due against the above

    officials for their failure to comply with the law.

    d. The date by which you will now disseminate the information.

    e. Chairperson, chief guest and other distinguished guests and invitees

    g. Cost of organizing the event

    24. Please provide the following information about all events (for each event separately) that

    were organized by outside organizations either at Tees January Marg or Gandhi Darshan,

    Rajghat since January 2001:

    a. Dates of the event

    b. Name and address of the organization

    c. Name of the event

    d. Type of the event, viz., Conference, Camp, Symposium, Workshop, etc.

    e. Purpose of the event

    f. Programme copy and other literature available with you

    g. Request letter or other communication given by the organization to you in order to

    request for booking of the venue

    h. Copy of the letter or other communication given by you in confirmation of booking of

    the venue

    i. Revenue earned by you from the event with detailed break-up of the revenue.

    25. On 12th November, I had met Mr. R.S. Mathur for the booking of B.N. Pandey Hall for 23 rd

    through 25th of November. Mr. Mathur requested me to send in a faxed request which I did

    later that day. Subsequently, I received a letter dated 13.11.07 that since 24th and 25th

    November fall on holidays, the space could not be made available to us. Against this

    background, please provide the following information since January 2007:

    a. Days and dates of staff holidays including weekends

    b. Dates and names of events that happened on these holidays

    c. If other events could be held on holidays, our event could be held too. Please state

    reasons for making an exception in our case

    26. I wrote back on my original request letter in my handwriting and faxed it on 17.11.07,

    requesting for a booking on the first available three consecutive dates. I followed up the

    faxed request with a call to Shri R.S. Mathur but was stunned to hear from him that your

    manager/director has decided that you would not give us space at all. Please provide the

    reasons for your refusal. I would like to point out that NyayaBhoomi has no previous

    association or relationship with your organization, save for some participation in and moral

    support to Jal Biradari and Yamuna Satyagraha a fact known to Shri Sharma, Dr. Savita

    Singh and Mr. R.S. Mathur.

    27. A weaver is found to be weaving fine cloth at Gandhi Smriti premises at Tees January Marg.

    Please supply me a specimen of such cloth under section 2(j)(iii).

    28. Please advise how the cloth such woven is sold/distributed/gifted.

    Information requested above is only a small part of the detailed research that we have

    undertaken to assess the performance of your organization vis--vis the primary objectives for

    which public funds are invested in you. More requests for information will follow soon.
