Terms and condition

1. Method of application: Technical bid page along with mentioned attachments and

properly sealed financial bid should be submitted in a bigger sealed envelope clearly stating “Bid for carrying out works at Vadodara District” and should reach the office personally or through registered post / courier. અર� કરવાનો પધ્ધિત : Technical Bid ના કાગળો તેમા ં દશાર્વેલ કાગળો સાથે અને એક

અલાયદા બધં કવરમા ં“Financial Bid “ સાથે એક બી� મોટા બધં કવરમા ંરાખીને �બ�ુ અથવા

ર�સ્ટર પોસ્ટ / �ુ�રયર થી મોકલવાનો રહ�શે. આ બધં કવર ઉપર “ Bid for carrying out Civil

works at Vadodara District” દશાર્વવાના ંરહ�શે. 2. Purpose of this tender: This tender is to invite bids for selecting agency willing

to carry out various works at Di f f er ent Tal ukas Vadodara District , few of which are indicated in this document, at a specified percentage of SOR at the indicated work sites. આ ટ�ન્ડર હ��:ુ આ ટ�ન્ડર એવી રસ ધરાવતી એજન્સીઓ, ક� � વડોદરા �લ્લાના તા�કુાઓમા ં

આવેલ આ િવભાગ હ�ઠળની ર�ન્જમા ં સીવીલ કામ કરવા ઈચ્છા ધરાવતી હોય, પાસેથી બીડ

આમિં�ત કરવામા ંઆવે છે. 3. Who can apply: Any person / agency fulfilling following criteria can apply

a. Valid PAN card number (Copy to be submitted) b. Should have executed similar works in any government department (Copy of

work order to be submitted) Should have a turnover more than Rs 5,00,000/- in any of the two last financial years. (Copy of IT return to be submitted) And priority will be given to the experience into the Civil Work Agency.Who Worked Related Civil work with Forest Department

4. Tender fee (ટ�ન્ડર ફ�) : Rs 500/- by any mode like Cash, BD, DD etc.

ટ�ન્ડર ફ� :�.૫૦૦ / - ક�શ, બીડ�, ડ�ડ� વગેર� �વી કોઇ પણ �કાર �ારા ર�ુ કરવા�ુ ંરહ�શે. 5. EMD: Refundable Earnest Money Deposit of Rs 50,000/- will have to be deposited

along with the application in form of Demand draft or Bank Draft issued by a scheduled bank. The EMD will be retained till the process is over or one month whichever is early.

રાખવામા ંઆવશે. 6. The payment will be calculated based on the actual work executed and the

percentage indicated. Example if the percentage of the successful bidder is 110% and the estimated amount of the work as per the Technically Sanctioned estimates is 30,000/- then the admissible payment for that work would be Rs 33,000/-. �કુવણાની રકમ ખર�ખર કામનો જથ્થો, SOR અને નકક� થયેલ ટકાવાર� �માણે નકક� કવરામા ં

આવશે. દા.ત. જો સફળ એજન્સી�ુ ંનકક� થયેલ દર ૧૧૦ ટકા છે અને કામગીર��ુ ંતાિં�ક મ�ુંર�

મળેલ એસ્ટ�મેટની રકમ �. ૩૦,૦૦૦/- હોય તો એજન્સીને તે કામ માટ� �ા. ૩૩,૦૦૦/- મળવાપા�

રહ�શે. 7. The payment will be released as soon as possible but since it is dependent on

availability of grant from higher offices no firm commitment can be given for the same. �કુવણા ં માટ� ર�ુ થયેલ બીલ/વાઉચર, �કુવણા ં ફંડની ઉપલબ્ધતાને આધીન શ� ત્વરાએ

કરવામા ં આવશે, �કુવ�ુ ં ફંડની ઉપલબ્ધતા પર આધા�રત હોવાથી આ માટ� કોઇ બાહ�ધર�

આપવામા ંઆવતી નથી. Scope of work, execution of work, penal clauses and other conditions

8. The exact type of work and quantity of work is still undecided but the typical indicative kind of works are Wild Ani mal, Enclosure, Ghats, Van Kutir,Van chetana Kendra, Toilet at Nursery, Maintenance of Division/Range Office , Small Check Dam, Small Causeway, Pathway, CC or RCC roads, fencing etc. The exact type, quantity of various items, place etc. will be decided by the Deputy Conservator of Forests based on the technical inputs from the selected agency, site requirement, fund availability etc. The deputy conservator of forest will have full right to drop or modify or add any item in the indicative list even after finalisation of tender and will be binding on the agency. હાલમા ં કામગીર��ુ ં ચોકકસ �કાર અને જથ્થો િનિ�ત નથી પણ સામાન્ય ર�તે વન્ય�વ,

એન્ક્લોઝર, ઘાટ, વન�ુટ�ર, વન ચેતના ક�ન્�, નસર્ર�મા ંટોઇલેટ,ડ�વીઝન/ર�જ ઓફ�સ મરામત,

નાના ચેકડ�મ, ના� ુ કોઝવે, રસ્તા�ુ ંકામ, સી.સી.રોડ, આર.સી.સી.રોડ, ફ�ન્સ�ગ �વી કામગીર�

કરવાની હોય છે. કામગીર�નો ચોકકસ �કાર, જથ્થો, જગ્યા િવગેર� એજન્સી પાસેથી તાિ�ક

અ�ભ�ાય, સ્થળની જ�ર�યાત, ફંડની ઉપલબ્ધતા િવગેર�ના આધાર� નાયબ વન નાયબ સરંક્ષક�ી

�ારા પાછળથી �ણ કરવામા ંઆવશે. નાયબ વન સરંક્ષકને કોઈને કોઈ કારણ આપ્યા વગર ટ�ન્ડર

આખર�કરણ પછ� પણ આ ટ�ન્ડર મા ંદશાર્વેલ િવિવધ કામો પૈક� કોઇ પણ કામ ને પડ�ુ ં�કૂવા�ુ ં

સ�ંણૂર્ અને આબા�દત અિધકાર રહ�શે. 9. The party quoting least percentage will be declared as L1 and will be selected

provided it fulfils all other conditions. � એજન્સી સૌથી ઓછ� ટકાવાર� મા ંકામ કરવા તૈયાર હોય અને ટ�ન્ડરની અન્ય શરતો પર��ણૂર્

કર� તેને L1 તર�ક� �હ�ર કરવામા ંઆવશે.


10. The agencies will have to specify at what percentage of SOR (Standard Operating Rates) they are willing to carry out works. Ex if the agency is willing to work at 105% of the rates specified in the SOR then he has to write just 105% in the column “The percentage of SOR at which I am / we are willing to work “of the financial bid. સબિંધત એજન્સીએ SOR (સ્ટાન્ડડર્ ઓપર��ટ�ગ દરો) ના ક�ટલા ટકાવાર�ના દર �જુબ તેઓ કામો

હાથ ધરવા માટ� સમંત છે તે સ્પષ્ટ દશાર્વવા�ુ ંરહ�શે. દાખલા તર�ક� � સબંિધત એજન્સી SOR મા ં

િનદ�ષ્ટ કર�લ દરોના 105 % �જુબ કામ કરવા માટ� તૈયાર હોય તો તેને નાણાકં�ય �બડના “�

ટકાવાર� દર �ુ ં/ અમે કામ કરવા માટ� તૈયાર �/ં છ�એ " કોલમમા ં105 % દશાર્વવા�ુ ંરહ�શે. 11. The indicated percentage would be applicable to all the works to be carried out under

this contract. આ ટ�ન્ડરમા ંનકક� થયેલ ટકાવાર� બધા કામ માટ� લા� ુમાનવામા ંઆવશે.

12. The rates calculated as per indicated percentage quoted would be inclusive of all the taxes like service tax, professional tax , income tax etc. If required as per rules the TDS would be deducted from the payment. દશાર્વેલ દરોમા સિવ�સ ટ�ક્સ, �ોફ�શનલ ટ�ક્સ, આવક વેરો િવગેર� તમામ કરો સામેલ કરવા� ુરહ�શે.

જ�ર� જણાશે તો �કુવ� ુકરતી વખતે િનયમ �જુબ ટ�ડ�એસ કપાત કરવામા ંઆવશે. 13. The agency will have to get the design prepared as per instruction of the deputy

conservator of forest within 3 days of issuance of work order or letter asking for the same. Based on the design the agency will have to get the estimates prepared as per the prevalent SOR and obtain technical sanction from an appropriate authority. એજન્સી �ારા �ડઝાઇન વકર્ ઓડર્ર અથવા તે હ��નુા પ� મળવાના 3 �દવસની �દર નાયબ વન

સરંક્ષકની �ચૂના �જુબ તર�ક� તૈયાર કરવા�ુ ં રહ�શે. �ડઝાઇન �વતર્માન SOR �જુબ તૈયાર

કરવા�ુ ંરહ�શે અને યોગ્ય સ�ા પાસેથી તાિં�ક મ�ૂંર� મેળવવાની રહ�શે. 14. The agency must start the work within three days of issue of work order. If the agency

fails to execute the work within 30 days of execution of work order then a penalty at the rate of 1 % per day of delay (subject to maximum of 10%) to be calculated on the total work order amount, may be imposed. It may be waived off by the Deputy conservator of forests if the delay is not because of the reasons attributable to the agency. The decision of the Deputy conservator of forests will be final in this respect. એજન્સી વકર્ ઓડર્ર મળ્યેથી �ણ �દવસની �દર કામ શ� કરવા�ુ ંરહ�શે. જો એજન્સી ૩૦ �દવસની

�દર કામ કરવામા ંિનષ્ફળ જશે તો વકર્ ઓડરની �ુલ રકમના ૧% �દવસ �માણે (મહ�મ ૧૦%ની

મયાર્દામા) તેમના પાસેથી દંડ વ�લુ કર� શકાશે. જો નાયબ સરંક્ષક�ીને એમ જણાશે ક� એજનં્સી

પાસે આ િવલબં એજનં્સી ના કારણે નથી તો નાયબ વન સરંક્ષક�ી આ દંડ માફ કર� શક� છે. આ

સદંભર્મા ંનાયબ સરંક્ષક િનણર્ય �િતમ રહ�શે. 15. If the agency fails to execute the work with the required quality or the delay is already

more than 10 days or is likely to be more than 10 days then the contract can be cancelled and any other agency willing to work at that rate can be awarded the work. In such cases the agency will be paid on the basis of the actual work done on the spot. The decision of the Deputy conservator of forests will be final in this respect.


જો સબંિધત એજન્સી તેને સોપેલ કામગીર� �ણુવ�ાસભર ના કર� અથવા િવલબં ૧૦ �દવસથી

વધાર� થઇ ગયા હોય અથવા ૧૦ �દવસથી વધાર� િવલબં થવાની શ�તા હોયતો તેને તાત્કા�લક

અસરથી કામગીર� પરથી �ુર કર�ને િનયમ�ુસંાર તેનો કરાર રદ કરવામા ંઆવશે, અને ત્યાર પછ�

જો અન્ય કોઇ એજન્સી આ દરથી કામગીર� કરવા સમં� હશે તો તેને કામગીર� સોપવામા ંઆવશે.

આવા સજંોગોમા ંસબંિધત એજસંીને �કુવ� ુસ્થળ ઉપર ખર�ખર કર�લ કામગીર� �જુબ કરવામા ં

આવશે. અને આવા સજંોગોમા નાયબ વન સરંક્ષક�ીનો િનણર્ય આખર� રહ�શે. 16. Applications are liable to be summarily rejected due to incomplete, incorrect

information or non-fulfilment of eligibility criteria. અ�ણૂર્, ખોટ� મા�હતી આપનાર અથવા યોગ્યતા માપદંડ ન ધરાવતા હોય તેવા બીડ ને

સ્વીકારવામા ંઆવશે ન�હ. 17. Tenders received late on account of any reason whatsoever will not be entertained.

કોઈ પણ કારણસર થી િવલ�ંબત ટ�ન્ડર ને સ્વીકારવામા ંઆવશે ન�હ 18. The rates quoted should include all kinds of cost like material, labour, transportation

etc. દશાર્વેલ દરમા ંતમામ �કારના ખચર્ �વી સામ�ી, મ�ૂર�, પ�રવહન વગેર� સમાવેશ કરવાનો રહ�શે.

19. The agency will be asked to execute the work directly by the RFO. The agency will have to execute the work within the specified time and produce the bill within 7 days of completion of work clearly specifying the items sanctioned SOR , agreed percentage, quantity etc to the concerned RFO. RFO may also instruct to get the signatures of concerned Forester or Guard if they have been allotted the work of the supervision. સબંિધત ર�ન્જના પર�કે્ષ� વન અિધકાર� �ારા ��ુચબધ્ધ એજન્સીને કામગીર� માટ� �ુકમ આપવામા ં

આવશે. એજન્સીએ કામના ન�� કર�લ ધારા-ધોરણ અને િનયત કર�લ સમયે કામગીર� �ણુર્ કર�,

કામગીર� �ણુર્ થયાના ૭ �દવસમા ં�કુવણી માટ�ના બીલ ર�ુ કરવાના રહ�શે. મ�ુંર થયેલ SOR

એજન્સી �ારા સ્વી�ૃત ટકાવાર� દર, કામનો જથ્થો વગેર� િવગતો સાથેના બીલ હદના બીટગાડર્/

ફોર�સ્ટરોની �િત સહ� મેળવી પ�રકે્ષ� વન અિધકાર��ીની કચેર�મા ંર�ુ કરવાના રહ�શે. 20. The agency will have to get the technical sanction for the work from appropriate

authority before starting the work. એજન્સીએ કામ શ� કરતા પહ�લા યોગ્ય સ�ા પાસે થી કામ માટ� તાિં�ક મ�ૂંર� મેળવવાની રહ�શે.

21. The agency will have to maintain the measurement books etc which must be maintained properly by the agency and also get the signatures of the concerned officers as per instructions. એજન્સીએ આ કામગીર�ની માપપોથી (Measurement book) વગેર� યોગ્ય ર�તે િનભાવવાની

રહ�શે. અને �ચૂના �માણે સબંિંધત અિધકાર��ીની સહ�ઓ પણ મેળવાની રહ�શે. 22. Even after payment if any deficiency is found in quality or quantity in the works then

also the agency will be penalised and may even be blacklisted. થયેલ કામગીર�ની �કુવણી થયા પછ� પણ તેની �ણુવ�ા અથવા જથ્થામા ંકોઈ ક્ષિત જોવા મળશે

તો, એજન્સીને દંડ કરવામા ંઆવશે અને જ�ર જણાયતો તેને બ્લેક �લસ્ટ કરવામા ંઆવશે.


23. Deputy conservator of forests will have full rights to issue any clarification regarding the interpretation of any of the terms or condition in the interest of better execution of work and the same will binding on the agency. કામગીર� વ� ુસાર� ર�તે થઇ શક� તે માટ� શરતો અને િનયમોના અથર્ઘટન �ગેનો અબાિધત હ�

નાયબ સરંક્ષક�ીનો રહ�શે અને તે એજન્સીને તે બધંનકતાર્ રહ�શે. 24. The agency will be solely responsible legally and financially to ensure compliance of

any act like minimum wages, ID act , insurance, transportation, medical, workman compensation, safety etc. The agency will have to provide all the necessary medical and safety devices on the work spot. અ�ન્સી �ારા કામગીર� પર રોકવામા ંઆવેલ મ�ુરોને લગત તમામ કાયદાક�ય બાબતો, �વી ક�

મ�ુર િવમો, મ�ુર કાયદાનો અમલ, ઔધોગીક િવવાદધારો, ન્�નુતમ દ� િનક વેતનદર, �રુક્ષા

વગેર� કાયદાઓ� ુ પાલન અને તેમાથંી ઉપ�સ્થત થતી તમામ કાયદાક�ય અને નાણાક�ય

જવાબદાર��ુ ંવહન કરવા�ુ ંરહ�શે. કામ પર આવતા મ�ુરોની �રુક્ષા સબંિંધત તમામ સાધન-

સામ�ી એજન્સીએ �રૂ� પાડવાની રહ�શે. �ના અભાવે કોઇ અકસ્માત/�ુધર્ટના બનશે તેની સમ�

જવાબદાર� સ�પેલ એજન્સીને રહ�શે અને તેઓને ન્યાિયક અને ફોજદાર�ની તમામ બાબતોની

જવાબદાર� રહ�શે. કામગીર�ના સ્થળે એજ્ન્સીએ તમામ �કારની મેડ�કલ અને �રુક્ષા ઉપકરણોની

વ્યવસ્થા કરવાની રહ�શે. 25. The successful agencies will be required to furnish an affidavit duly notarised in the

format provided by the Deputy conservator of forests. એજન્સીએ નાયબ વન સરંક્ષક�ીની કચેર�મા ંિનયત કર�લ ન�નુામા ંકરાર �ગે�ુ ંએફ�ડ�વીટ કર�

તેને નોટર� પાસેથી �મા�ણત કરાવી ર�ુ કરવા�ુ ંરહ�શે. 26. The Deputy conservator of forests will have full rights to suspend or even terminate

this tendering process at any stage without assigning any reason to anyone. નાયબ વન સરંક્ષક�ીને આ ��યાને કોઈપણ તબ�ે આ કામગીર� સ્થ�ગત અથવા સમાપ્ત કરવા

માટ� સ�ંણૂર્ અિધકાર રહ�શે. 27. If there is any question of interpretation between the English version or Gujarati

version of the provisions the English version would prevail જો જોગવાઈ�ુ ં��ે� આ�િૃ� અને �જુરાતી આ�િૃ� વચ્ચે અથર્ઘટન �ુ ંકોઈ �� ઉપ�સ્થત

થાય તો ��ે� આ�િૃ� ને સા�ુ ંગણવામા ંઆવશે.
