AIM Agreement concerning the Relationships between Carriers in respect of

International Freight Traffic by Rail

CIT International Rail Transport Committee

Consignor A keeper or a third party authorised by the keeper who hands over an empty wagon as a means of transport to a user railway undertaking for haulage (see Article 9.1 GCU).

Customer Agreement

The special agreement concluded between the consignor and the user railway undertaking in respect of one or more consignments subject to the GCU.

Railway undertaking (RU)

Any public or private undertaking, licensed according to applicable Community legislation, the principal business of which is to provide services for the transport of goods and/or passengers by rail with a requirement that the undertaking must ensure traction; this also includes undertakings which provide traction only.

Wagon keeper or keeper

means the person or entity that, being the owner of a wagon or having the right to use it, exploits the wagon as a means of transport and is registered as keeper of the wagon in the competent official vehicle register, or, if the wagon is not registered in the competent official vehicle register or such a register is not existing, the person or entity that has declared to the GCU Bureau to be keeper of the wagon.

2 Purpose of the manual

Use of wagons as means of transport is subject to the CUV Uniform Rules and the GCU. Empty wagons hauled in accordance with the GCU are to be accompanied by a wagon note. This manual lays down how wagon notes and other documents relating to the haulage of empty wagons accompanied by a wagon note are to be handled. Railway undertakings using the wagon may nevertheless agree derogations. When haulage is performed throughout by a single railway undertaking, it may apply this manual or special provisions. Provisions of the railway undertaking using the wagon apply to issues that this manual does not cover. The appropriate department within the railway undertaking using the wagon should be contacted in the case of doubt on how the manual is to be applied. This manual is intended for members of the CIT who will make it available to their staff or incorporate its contents into their own wagon manuals. The list of CIT members who apply this manual is published on the CIT website (www.cit-rail.org).

3 Scope This manual applies to the haulage of empty wagons subject to the GCU as means of transport. The railway undertaking using the wagon may entrust the performance of various services to third parties. In that case, a third party may only process the wagon note in the name of and for the account of the user railway undertaking and in accordance with its instructions. Wagons may also be consigned loaded or empty as goods. In that event they are then the subject of a CIM contract of carriage and the GTM-CIT manual applies to them.

4 Electronic wagon note

4.1 Principles In accordance with point 8 of the GLW-CUV, the wagon note and its duplicate may be created in the form of an electronic data record which can be transformed into legible written symbols. The provisions in this manual are equally valid for consignments covered by paper or electronic wagon notes. When special provisions are necessary for electronic wagon notes, they are specially mentioned.

4.2 Specific provisions For the relationship between the consignor/consignee and the railway undertaking, see Chapter D of the GLW-CUV and Appendices 1a and 1b. For the relationships between the railway undertakings, see Appendices 1a and 1b.

6 Working sheets

Notes: - For each process, a working sheet provides information on the purpose of the process, the

activities to be undertaken, the timescales to undertake them and the parties taking part. - The activities may be undertaken at stations, at regional centres, at customer service centres,

etc. Railway undertakings are to define which locations are competent to handle documents which have to be produced as appropriate, for example, the duplicate of the wagon note in the event of giving orders or instructions.

- Correspondence and documents for international rail traffic are to be sent by e-mail, internet,

fax, as service post, ordinary post, registered post, etc. as a function of circumstances and what is available.

A list of the departments within railway undertakings’ organisations which distribute mail to

departments whose address is unknown, or who provide useful information for sending documents is available on the CIT website: www.cit-rail.org. Addresses of the various departments of railway undertakings which handle wagon issues are likewise available on the CIT website: www.cit-rail.org.

- The content of the forms shown in the appendices of this manual must comply with the

specimens in the appendices and it is recommended that the design be the same. When the forms are produced by means of a computer printout, the following conditions must

be observed:

colour of print: as in the specimen or black,

content: no departure from the specimen,

paper size and design: depart as little as possible from the specimen,

paper: suitable for the printer being used. Electronic methods such as the internet or e-mail are to be preferred to allow the flow of

information to be speeded up. With this in mind, forms to download, complete, print-out and send electronically are available on www.cit-rail.org.

- The date stamps referred to in the working sheets below must comply with the following

specification:1 Size and shape: rectangular or oval, width 44 mm, height 28 mm (maximum). Content: name of the railway undertaking, name of the station, year, month, day. They may also include: distinctive symbols, details of the time.

of the commercial offer

Wagons: - the railway undertaking is to check if haulage is authorised, - the railway undertaking is to check traffic restrictions in force.

Transport documents: - the railway undertaking is to decide the type of wagon note to be used

(electronic/paper, choice of design, etc.) - the railway undertaking is to list the documents attached to the wagon

note and the conditions for their movement.

If the instructions necessary are not supplied (Article 14.3 GCU): - If the keeper has not supplied instructions before the railway

undertaking takes back an unloaded wagon, unless otherwise agreed with the keeper, the railway undertaking is to make out a wagon note, and as appropriate a charges note in accordance with Article 14.2 GCU and use it.

each wagon or send the transport order message where electronic wagon notes are being used.

- The entries on the wagon note must be written or printed indelibly.

Wagon notes that have alterations, erasures, or slips of paper glued to them are not permitted. Crossing out is only permitted if the consignor or the railway undertaking (if it makes out the wagon note) acknowl-edges it by signing the wagon note.

GCU 14.2, GLW-CUV

- A wagon note must be made out for every wagon. Exceptions to this rule (for example a wagon note for a block train or for a group of wagons) are to be documented in customer agreements. If several wagons are consigned with a single wagon note, as many copies of the list of wagons must be attached to it as are stipulated.

If a block train or group of wagons includes wagons subject to the CIM

Uniform Rules in addition to empty wagons accompanied by a wagon note then see Appendix 1 GLW-CUV – explanatory notes to box 30 of the wagon note.

The number of wagon lists attached must be shown on the wagon note.

Customer agreement checklist point 5

- Wagon note with a supplementary sheet for an intermediate section: the wagon note may be printed with such a sheet intended for a railway undertaking which invoices. It is placed after sheet 3. It is to be endorsed “Invoice for intermediate section” and is numbered 2a. In addition it must be marked on the back with “Supplementary invoice for invoicing by a railway undertaking other than the forwarding or destination railway undertaking”. Appendices 2a/2b contain a specimen of sheet 2a of a wagon note with an invoice for an intermediate railway undertaking which invoices.

- If the wagon note is not a standard design or if the content does not comply with the requirements of the GLW-CUV, the situation is to be clarified with the consignor. If the issues cannot be resolved, the wagon note is to be refused. For exceptions see GLW-CUV, point 4.3, last paragraph. With that exception, the railway undertaking may not change or supplement the information which the consignor enters on the wagon note.

over by the consignor.

Notes For electronic wagon notes, the consignor is to be asked to attach only those documents which are absolutely needed during haulage to the wagon note. Ensure that every opportunity has been taken to send documents direct to the consignee or just to produce them at the point where they are needed. If these documents are sent to the railway undertaking in electronic form, the arrangements for processing them and issues of liability should be addressed in the EDI contract.

Railway undertaking

- The railway undertaking is to check if the documents listed on the

wagon note and which are to accompany it are attached.

- The railway undertaking is to take account of the special provisions for empty wagons which contain the residue of dangerous goods.

1.4.2.2 RID UIC leaflet 471-31

- The railway undertaking is to clarify any irregularities noticed with the consignor.

- If applicable, the railway undertaking is to enter references to the

consignment on the documents. - The railway undertaking is to process the accompanying documents in

accordance with the provisions in force.

Observations In order to create a link between the papers and the wagon note when electronic wagon notes are used, the consignment identification number is to be entered on the accompanying documents. Alternatively an accompanying document in accordance with Appendix 18 is to be used. The accompanying documents are to be attached to that form.

- To complete the wagon note with other information from the railway undertaking. - To inform the various participants of the details of the consignment.

Time At the latest before the wagon moves. Participants Activity References Railway undertaking

- The railway undertaking is to complete the wagon note with its own

information. The “prior notification” message is to be used for electronic wagon notes. The railway undertaking is to send that message to all the railway undertakings which are to participate in the movement.

GLW-CUV – Appendix 1, boxes 40 et seq

- The railway undertaking is to allocate a consignment identification number (box 62 of the wagon note): see Appendix 3 to this manual.

- The railway undertaking is to calculate and enter charges: the railway undertaking should calculate all the charges it is able to calculate, whatever the instruction on who is to pay them. Each railway undertaking which calculates charges is to use a separate charging section. The supply of the duplicate of the wagon note message is to be used for electronic wagon notes.

- If more than seven charging sections are necessary, the railway undertaking is to use additional sheets (invoice and original of a new wagon note). These are to be completed in the following way: . box 21: enter “additional sheet for consignment number … from … to

… ” . charging sections: the details required . box 62: consignment identification number of the original wagon note . box 56 of the wagon note is to be endorsed “additional sheet”.

- If the wagon note is printed out by a computer printer and the back of the sheet has to be printed separately, the following information must be printed on the separate sheet “back of wagon note No…. from … to …, charging sections: the details necessary”.

GLW-CUV 11

- For those charges accepted by the consignor which cannot be precisely totalled at the time of acceptance, the railway undertaking is to attach a charges note complying with the specimen shown in Appendix 4 of the GLW-CUV. Appendix 4 contains an explanation of how to use the charges note. Charges notes are not made out on departure if electronic wagon notes are used (charges note data which has to be returned may be included in a “supply of the original of the wagon note” message).

- The railway undertaking is to return sheet 4 (Duplicate of the wagon note) to the consignor. In the case of an electronic wagon note, the supply the duplicate of the wagon note message is to be sent or a “duplicate of the wagon note” printout given to the consignor.

- The railway undertaking is to retain sheet 5 (duplicate invoice).

- The railway undertaking is to forward the wagon and the wagon note (sheets 1 to 3) with the accompanying documents by the same train or provide prompt access to the information (if needed) in another way. The electronic wagon note message is to be used for electronic wagon notes.

- The consignor is to comply with the special provisions for exceptional

consignments.

- Appendix 14 defines how labels conforming with the specimens in that appendix are to be used. Agreements between railway undertakings define the information which labels complying with the specimens shown in Appendix 14 must contain. If the consignor labels in accor-dance with an agreement with the railway undertaking, the labels he has put on are to be checked.

the wagon in the context of the contract of use.

02 Handover between user railway undertakings 02 - 01 Processing of the wagon note and accompanying documents Purpose To document all the various participants who actually take part in haulage

on the wagon note.

Notes The point, time and arrangements for the handover of wagons between

railway undertakings are to be set down in agreements between them.

wagon note” message with the first wagon.

Receiving railway undertaking

- The receiving railway undertaking is to accept the wagon note and the

accompanying documents.

- The receiving railway undertaking is to confirm acceptance of the consignment on the wagon note, if necessary correcting the information shown in box 57. The “electronic wagon note” message is to be used for electronic wagon notes.

Observations If the “electronic wagon note” message is sent before handover of the wagon, the railway undertakings are to agree which message establishes the time of handover of the right to process the wagon note from one railway undertaking to the other. For block trains and groups of wagons on a single wagon note this message is based on the first wagon handed over.

Handing over railway undertaking

- The handing over railway undertaking is to make the checks required

and remedy any irregularities noted; if the wagon is damaged a wagon damage report is to be made out without delay.

- The handing over railway undertaking is to hand over the wagon to the

receiving railway undertaking.

Receiving railway undertaking

- The receiving railway undertaking is to accept the wagon.

- The receiving railway undertaking may refuse to accept the wagon when: - its acceptance is prohibited by a competent authority; - it is temporarily impossible to accept the wagon for operating

reasons specific to the railway undertaking concerned; - there are exceptional circumstances beyond the control of the

railway undertaking (cases of force majeure in particular) that temporarily prevent the wagon being accepted;

- the condition of the wagon does not meet technical and maintenance regulations or conform to current loading guidelines;

- there are other substantial reasons which might affect the safe operation of the wagon; such reasons must be notified to the keeper

A railway undertaking may not refuse its own wagons when they are

empty and in running order.

Observations If traffic to be handed over is refused when an electronic wagon note is being used, one of the following options may be used to process a wagon note which has already been handed over in the technical sense of the term; - the electronic wagon note is formally returned to the handing over railway undertaking. The

option to process the wagon note remains technically open to the receiving railway undertaking which is to process it at the request of and in accordance with the instructions of the handing over railway undertaking until the problem which prevented handover is resolved;

- the receiving railway undertaking produces a printout of the electronic wagon note and hands it to the handing over railway undertaking at the same time notifying it of the refusal;

- the receiving railway undertaking halts the processing of the electronic wagon note in its system and the handing over railway undertaking manually reactivates the wagon note in its system.

03 Amendment of the details of the movement 03 - 01 Acceptance and transmission of subsequent orders Purpose To allow the consignor to take control of the wagon and to amend the

details of the movement by means of subsequent orders.

Notes The provisions of Articles 18 § 1 and 19 §§ 1 to 6 CIM apply by analogy.

Nevertheless, only the consignor is authorised to give instructions.

Checklist for the contract for electronic interchange of wagon note data (EDI contract checklist) Preamble This checklist contains recommendations in the form of boilerplate clauses and comments for drafting EDI contracts (contract for the exchange of electronic consignment note data for the international carriage of goods by rail and electronic wagon note data for the movement of empty wagons as means of transport). The checklist is suitable for use both for relationships between customers and carriers and between carriers themselves. It may also be used for relationships between keepers and railway undertakings and between railway undertakings themselves.

2.6 Mixed system Successive use of the following data media for a single consignment. These data media represent the con-signment note or wagon note: paper consignment note or wagon note, electronic consignment note or wagon note, print-out used as a paper con-signment note or paper wagon note.

2.7 EDI Electronic Data Interchange means the electronic transfer of data between IT systems in the form of EDI mes-sages.

2.8 EDI message A set of segments, structured using an agreed standard, prepared in a com-puter readable form and capable of being automatically and unambigu-ously processed.

3 Objective of the EDI contract

The EDI contract only defines the conditions in which an electronic consignment note or electronic wagon note are made out and used in a manner which is legally valid. It guar-antees:

- that the electronic consignment note/electronic wagon note is equivalent to the paper consign-ment note/paper wagon note,

- the quality of the data,

- the security of transmissions. The EDI contract is not intended to cover the rights and obligations arising from the contract of carriage or the contract of use for the wagon.

The objective of the EDI contract is to define the conditions in which the use of an electronic consignment note or an elec-tronic wagon note has legal effect within the terms of the CIM Uniform Rules or the CUV Uniform Rules and the GCU. The use of electronic consignment notes or wagon notes is to be managed by means of customer agreements between customers and contractual carriers, or through contracts of use between customers and user railway undertakings that accept empty wagons for movement. Explicit references to EDI contracts in customer agreements or in contracts of use for wagons will clarify the contractual architecture.

4 Equivalence of the elec-tronic and paper versions of the consignment note, and of the electronic and paper versions of the wagon note

Electronic consignment notes/electronic wagon notes which are used by the parties to the con-tract of carriage, or the contract of use for the wagon, are to be regarded as equivalent to paper consignment notes/paper wagon notes. The parties may not challenge the evidential value of electronically transmitted consignment note/wagon note data simply on the grounds that it is electronic.

This assumption is refutable. No party may assert before a court or tribunal that the elec-tronic data exchanged is not of itself adequate evidence of the contract of carriage or contract of use for the wagon. Never-theless, a party may assert that the data is incomplete, inaccu-rate, insecure, etc.

5 Content of the electronic consignment note or electronic wagon note

Electronic consignment notes and wagon notes must include all the elements of paper consignment notes and wagon notes. The electronic data which is necessary to make electronic consignment notes valid is defined in Appendix 2 to the GLV-CIM and, for electronic wagon notes, in Appendix 1 to the GLW-CUV. Independently of the requirements for the content of the elec-tronic consignment or wagon note, railway undertakings must take account of the requirements agreed for the system (iden-tification of participants, etc.) and for the data (security, integ-rity, amendments permitted, archiving, etc.). If necessary, they are to agree to use an electronic signature. The consignment note and wagon note also have other func-tions (e.g. as a tax document). In these cases the railway undertakings in question are required to observe any appro-priate requirements of national law. Electronic documents may be attached to electronic consign-ment notes or electronic wagon notes. It is recommended that the arrangements for using them and the liability issues are covered in the EDI contract and that care should be taken to limit liability to processing the documents properly (no liability for the content of the documents).

6 Completion of the electronic consignment note/wagon note

6.1 Obligation to check the

completeness and accuracy of the data

Parties to the contract of carriage or to the contract of use for the wagon who input data into the IT system are to undertake to check carefully that electronic consignment notes/wagon notes actually contain all the data required in accordance with point 5 and that this data is accurate.

6.2 Integrity of the data The procedure used for filling out the electronic consignment note/wagon note is to ensure the data it contains remains unchanged once it has been input by the parties.

The data contained in the electronic consignment note/wagon note record, once input and authenticated by the parties con-cerned, must remain unaltered. That does not preclude authorised amendments and additions from being made sub-sequently (see point 7.4). However, the original data must remain (legible) in the IT system so that it can at least be con-sulted subsequently.

7 Transmission of the electronic consignment note/wagon note

7.1 Format of EDI messages

The requirements for EDI messages (transmission, content, timing, etc.) are shown in Appendix 7b to the GTM-CIT and Appendix 1b to the GTW-CIT. The parties to the EDI contract are to agree the standards and format for EDI messages and the codes for the data elements to be used.

7.2 Transmission and receipt of data

The procedure used for transmitting data must make it possi-ble to check if and when the data was sent and received by the persons participating in processing electronic consignment notes/wagon notes. If the “electronic consignment note” or “electronic wagon note” message is sent before handover of the consignment, the railway undertakings are to agree which message establishes the time of handover of the right to process the consignment note or wagon note from one railway undertaking to the other.

7.3 Security of transmissions

The methods used for transmitting electronic consign-ment/wagon note data must be secure. They must prevent unauthorised third parties accessing the data or changing it fraudulently. Rights of access to the data are defined in Appendix 2 to the GLV-CIM and Appendix 1 to the GLW-CUV. The parties may provide for an obligation to make checks and an obligation to update the processes used to protect the data from unauthorised access, unauthorised amendment, deletion, etc.

7.4 Amendments to the data

The data in the consignment note and wagon note may only be amended by those persons who are authorised in accord-ance with Appendix 2 to the GLV-CIM and Appendix 1 to the GLW-CUV (Rights of access to data). Contractual carriers and user railway undertakings who have accepted empty wagons for haulage are to be notified of amendments made in so far as that has been agreed by the parties. Any additions and amendments must be apparent and identi-fiable. IT systems must ensure that any amendments made as well as their source and time can be identified at least subse-quently. IT systems must create an audit trail of all amend-ments (see archiving, point 10). Fraudulent changes must be prevented as far as possible (see security of transmission, point 7.3).

8 Mixed system

A mixed system may be agreed in order to allow an electronic consignment note or wagon note to be used on sections of the journey before comprehensive implementation of the system. The procedures for this mixed system (see Appendix 7b GTM-CIT, point 5 and Appendix 1b GTW-CIT, point 5) must be examined in terms of legal requirements, particularly of national law, and specified in the EDI contract.

9 Printouts

A distinction must be made between situations in which the printouts have different functions and different values: 1) in a mixed system: the parties must agree the legal value

of printouts and the arrangements for replacing electronic consignment notes/wagon notes with printouts (and vice versa).

2) in a purely electronic system: printouts only have a legal value when they reflect the data in the electronic consign-ment note/wagon note faithfully and completely.

The appropriate specifications are shown in point 12 GLV-CIM, point 11 of the GLW-CUV, point 4 of Appendix 7b GTM-CIT and point 4 of Appendix 1b GTW-CIT.

10 Archiving of data The requirements of the law of carriage, customs law and tax law are to be taken into account when considering archiving electronic consignment notes/wagon notes. In principle, as a minimum the requirements for archiving paper consignment notes/wagon notes are to be satisfied.

11 Confidentiality All those participants involved in the processing of electronic consignment notes/wagon notes are subject to the general rules of confidentiality. Authorities with a right of access to the data under public law are generally subject to an obligation of confidentiality by this law.

12 Operational and organisa-tional requirements

12.1 Operational environment 12.2 Costs 12.3 Organisational measures

The parties are to undertake to create and maintain the oper-ational environment for the use of electronic consignment notes/wagon notes in accordance with the EDI contract. The parties are to specify how they bear the costs associated with the creation of this operational environment. The parties are also to agree organisational procedures required for the use of electronic consignment notes/wagon notes (for example: mutual notification of system problems and system errors). This remark is also to apply to fall-back procedures to cover IT system failures and cases in which paper documents have to accompany the consignment.

13 Liability 13.1 General comments

The parties are to agree a liability regime from the options set out below. The regime chosen should, in particular, encourage the parties to ensure that the quality of the data is maintained. Option A: A party is to be liable for the loss or damage caused to another party by disregard of one or more obligations arising from the EDI contract, unless he proves he was not at fault. This liability is limited to (…). This limit is not to apply if it is proven that the damage results from an act or omission on the part of the carrier or user railway undertaking, either with the intent to cause such damage, or recklessly in the knowledge that such damage would probably result.

13.1 (continued) The provisions of the CIM Uniform Rules and the GCU are to take precedence in the case of liability falling within the scope of the CIM Uniform Rules or the GCU. - to the customer agreement, or as applicable to the contract of use for the wagon,

- to the cooperation contract (for relationships between carri-ers or between railway undertakings).

15 Courts and tribunals Courts and tribunals are to be those agreed by the parties. It is recommended that they make the EDI contract subject to the courts or tribunals applicable:

- to the customer agreement, or the contract of use for the wagon, or

- to the cooperation contract (for relationships between carri-ers or between railway undertakings).

16 Duration, amendment, and termination of the EDI contract

The rules for the duration and amendment of the EDI contract and the severability of its provisions are to be those agreed between the parties. !t is recommended that they make the EDI contract subject to the rules applicable:

- to the customer agreement, or the contract of use for the wagon, or

- to the cooperation contract (for relationships between carri-ers or between railway undertakings).

Functional and legal requirements to be satisfied by the electronic wagon note 1 General provisions

For relationships between keepers and railway undertakings and between railway undertakings themselves, the electronic procedure must provide the same level of legal certainty as does the paper document. In particular, that includes

a) taking account of all the functionality of the paper wagon note as well as the comprehensiveness, quality and reliability of the data it contains;

b) archiving the data in accordance with the provisions on limitation of action, the provisions of national law and the terms of the EDI contract;

c) authenticating the electronic documents;

d) keeping the data secure and protecting it;

e) recognising electronic documents as having equivalent evidential value;

f) having options to transform these electronic documents into legible written symbols;

g) recording amendments and additions to an electronic wagon note, and retaining earlier data;

h) making the electronic process “convertible”, i.e. the option to be able to use both the electronic process and the classic paper process for the same consignment as a function of the wishes and capabilities of each of the participants (the mixed system);

i) ensuring that the data on dangerous goods consignments is available at all times and unrestrictedly to railway undertakings for their own internal checks before departure and en route (see point 5 UIC Leaflet 471-3), also in the case of irregularities or accidents, and for checks made by the competent authorities; see also sub-section 5.4.0 RID.

4 Printouts

4.1 Production

If necessary, the electronic wagon note is to be printed out. Printouts may only be produced for those functions which are necessary, and then only once with a given title (see point 4.2). Sheet 2 “Invoice” is an exception because along the route of a given traffic flow there will be railway undertakings which do not need paper documents to accompany consignments and those which do, it must therefore be possible to produce such a printout a number of times. See point 5.2 for the rules applicable in case of contradiction between the different printouts. The system must record the production of every printout together with the following data: type of document, date, time and the initiator of the printout.

If the length of data held in electronic wagon note records is too long for the space available in the appropriate boxes of the printouts or if data from the back of the wagon note is to be printed out, the following procedure is to be adopted:

- the “principal” printout is to be produced;

- one or more supplementary sheets are to be produced. These supplementary sheets must show the wagon note reference (consignment identification number) of the wagon note to which they belong, the date of acceptance of the wagon and show the data from those boxes of the electronic wagon note which could not be printed on the “principal” printout because of a shortage of space. The data is to be printed one field after another identified by the numbers of the corresponding boxes of the paper wagon note. On the principal printout, the remark “see supplementary sheet” is to be printed instead of the data itself in those boxes for which the data was too long.

4.4 Full train loads and groups of wagons

If several wagons are consigned together with a single wagon note, a wagon list in accordance with Appendix 23 is to be printed out.

5 Mixed system

5.1 Need for the system and definition of the system

In anticipation of comprehensive implementation, a mixed system may be agreed in order to be able to use the electronic wagon note on sections of the journey. It will allow different data media to be used for one and the same wagon (paper wagon note, electronic wagon note, printout used as a paper wagon note).

5.2 Evidential value of the various media The various data media used for a given wagon are to have the same evidential value. Where there is a contradiction1, for relationships between railway undertakings, railway undertakings to which wagons are handed over with printouts are liable on the basis of the data shown on those printouts, whereas railway undertakings to which wagons are handed over with paper wagon notes and who then input the data into electronic wagon note records are liable on the basis of the information shown on the paper wagon notes.

5.3 Agreement to the mixed system

Use of a mixed system is to be agreed between the participants. This may be by: - concluding an EDI contract (see Appendix 1a, point 8) with partners linked to the system for

electronic data exchange, - concluding special agreements or in the context of a contract to work together or a customer

agreement. The agreement must take into account the need to provide appropriate rules. This depends in particular on the roles of the partners in question, (forwarding railway undertaking, intermediate railway undertaking, destination railway undertaking) and the form their partnership takes (electronic link, by means of a printout, railway undertaking at the interface). Point 5.4 shows a checklist containing the more important issues. In addition, and in particular for free-standing agreements, fundamental legal clauses (scope, notice period, etc.) need to be included in addition to the specific issues.

5.4 Checklist for the use of the mixed system

The checklists include the more important issues which are to be taken into account in the use of a mixed system over and above rules for the electronic wagon note. Each participant is to examine the issues listed in part A and notify his partners of their implications for his requirements.

A. Issues of principle to be clarified before the application can begin:

Whether the use of several data media is permitted

If a change of data media is not permitted by the (national) law applica-ble; that at least prohibits a change of data medium taking place in the area in which the law applies. Whether it goes beyond that and totally excludes the mixed system for the flows in question is to be clarified in each individual case. For example: In a chain of states A-B-C involving successive railway undertakings, the railway undertaking in section C is not connected elec-tronically and the law that applies there does not permit change of data media. Conceivable circumstances are the mixed system is possible but the change of data medium must

take place in section B or the mixed system has to be excluded for the whole movement

because there is no “valid” wagon note under the law applicable in section C.

Electronic signature Define the requirements which the electronic signature forming part of the electronic application must satisfy in order to give the derivative printouts the evidential value they require (for example, for export or tax documentation).

Storage of data/ archiving of data/ access by adminis-trative authorities

In addition to satisfying the requirements of purely electronic or purely paper wagon notes (including printouts), the rules to be followed at interfaces and the means of ensuring they are followed are to be covered here in particular.

Use of CIT documents

Agreement to use CIT documentation to resolve general issues and define specific differences.

B. Issues to be resolved for application of the mixed system

Documenting the handover of the wagon note

All the electronic wagon note data which is to be exchanged is to be held in a journal. In the electronic mode, the journal is to be administered by the IT system. In the paper mode, the journal function is to be provided by a consignment handover list or another procedure agreed between the railway under-takings (see working sheet 02-01).

Consignor not connected to the IT system

Define rules for finishing with the paper wagon note, for archiving it and for data capture for the electronic wagon note record. Define rules for confirming the details of the movement by means of a printout.

Consignee not connected to the IT system

Define rules for producing and processing printouts of the electronic wagon note and for updating the electronic wagon note itself.

6 Rights of access to data

Access to wagon note data is only allowed to participants who have concluded an EDI contract and who also take part in the movement in question. Competent administrative authorities acting within the scope of their powers also have a right of access. Three types of access are to be distinguished: read, write (also includes the right to read) and amend (also includes the right to read and write). The right to read is ensured through an interface or by means of messages exchanged between the parties under the terms of the agreement signed between them. The right of a railway undertaking to write and amend data is limited to the railway undertaking which has custody of the wagon. The rights of access and the data which each person entitled may access are defined in Appendix 1 to the GLW-CUV.

Control label 1 Purpose

The control label is intended to identify a consignment consigned under the cover of a con-signment note or wagon note unequivocally.

4 Use

A control label is to be attached to each paper consignment note or wagon note; it is to show the identification number of the consignment. When identification numbers for consignments are allocated by computer, control labels need not be used. The identification number of the consignment (first and third lines) must be given in all correspon-dence, irregularity or dispute, and if applicable, written on accompanying documents.

Explanatory notes on the use of the charges note 1 Composition

The charges note is made up of three numbered sheets made up into a pad: Sheet 1: original of the charges note (to be given to the consignor by the railway undertaking after its return) Sheet 2: accounting copy (to be retained by the railway undertaking after its return) Sheet 3: audit copy (to be retained by the railway undertaking which returns the charges note)

3 Production

3.1 A charges note must be produced when not all the charges which a consignor accepts can be calculated by the forwarding railway undertaking. Production of a charges note is the responsibility of the forwarding railway undertaking. A cross () must be marked in box 52 of the wagon note.

3.2 As an exception, the charges note is to be made out by the railway undertaking where the charges arise if an electronic wagon note is used (nevertheless see point 4.2 last sentence).

3.3 Data for boxes 1 to 25 and 62 are to be taken from the same numbered boxes of the wagon note

in question.

3.4 A charges note form to download, complete and print-out is available on www.cit-rail.org.

4 Processing

4.1 On departure Sheets 1, 2 and 3 are to be attached to the wagon note.

4.2 En route Charges which arise en route or at the destination and which the payment instructions indicate are to be paid by the consignor, are to be entered on the charges note. If an electronic wagon note is used, these charges are only to be entered on the wagon note.

4.3 Return In principle, the charges note is to be returned by the destination railway undertaking. Nevertheless it may be returned by a railway undertaking en route if the instructions for payment of charges only include charges that arise up to that railway undertaking. A charges note form to download, complete, printout and send electronically is available on www.cit-rail.org. If electronic wagon notes are used, charges note data which has to be returned may be included in a “supply of the original of the wagon note” message. This delivery message is to be sent to the forwarding railway undertaking only if agreed with the last railway undertaking. The railway undertaking which returns the charges note must enter the month and the day of its return in box 52 of the wagon note.

Wagon label Use of the wagon label Wagons moving as wagon-load traffic must be labelled with wagon labels complying with the

specimen shown in this appendix. Railway undertakings may agree amongst themselves not to label wagons in this way.

Wagons moving in block trains from one consignor to one consignee are not labelled. If a wagon is

taken out of the formation en route for any reason, it must then be labelled. Railway undertakings may agree a procedure amongst themselves which departs from these instructions.

If wagon labels are put on wagons by consignors by agreement with the railway undertaking, they are

to be checked by the railway undertaking. A wagon label form to download, complete and print-out is available on www.cit-rail.org. The information in the “To” box must be written in block characters.

Electronic methods such as the internet or e-mail are to be preferred to allow the flow of information to be speeded up. With this in mind, an accompanying document form to download, complete, print-out and send electronically is available on www.cit-rail.org. A copy of the wagon note may be used instead of a specially produced form. The copy must be clearly marked “Accompanying document” along the upper edge. The data in box 30 and the sheet number information below box 59 are to be crossed through on this copy. The railway undertaking is to record the production of the accompanying document (as a specially produced form or as a copy of the wagon note) in box 56 (Carrier’s declarations) providing the following data;

- code and name of the railway undertaking;

- place and date completed.

Wagon list – Use in the event of wagons being detached If wagons from a block train or group of wagons consigned with a single wagon note and a wagon list are split up, the location, time and reason for splitting them are to be entered in box 56 of the wagon note. The details on the wagon note must not be amended however. The numbers of the wagons detached are to be crossed through on the copy of the wagon list which remains with the wagon note in such a way that they remain legible. The additional copy of the wagon list is to be used for the part of the train or group of wagons detached or an additional copy made out. The painted numbers of the wagons which have continued their journey with the wagon note are to be crossed through on this wagon list in such a way that they remain legible. If it is impossible to apply this procedure, an extract of the wagon list to cover the wagons detached is to be made out. That copy of the wagon list must be attached to a copy of the wagon note which is to be created and marked “Accompanying document” in accordance with Appendix 18 for the continuation of the journey of the wagons detached. If this is impossible an “Accompanying document” filled out with all the data from the wagon note in question in accordance with Appendix 18 is to be provided. If a block train or group of wagons covered by an electronic wagon note is split up, it may be agreed that the reason for splitting up the consignment is recorded by the railway undertaking providing haulage in the “carrier’s declarations” field. Carriers re-uniting the wagons with their wagon note are to remove the declaration. Paper documents (for example, accompanying documents, extracts from wagon lists) are only to be produced where specially agreed.

Notification of traffic restrictions 1 Traffic restrictions which are to be notified

Traffic restrictions which affect or could affect other railway undertakings are to be notified. “Traffic restrictions” means the action taken by the railway undertaking as a consequence of events (natural occurrences, strikes, threats of strikes, instructions given by railway undertakings, etc.) which have a short term effect (up to a maximum of two years) and restrict the transport services which can be offered:

- services withdrawn or suspended totally or partially,

- particular traffics not accepted or only accepted conditionally. Long term or permanent restrictions are to be reflected in the product offer. Nevertheless in urgent cases, notification within the meaning of this appendix may be made for such restrictions until they are taken into consideration in the product offer.

2 Infrastructure-related restrictions Information about traffic restrictions imposed by infrastructure managers and public authorities will be made available by means of network statements, databases, “one-stop shops”, etc.

3 Content of a notification of a traffic restriction The notification is to be in English, French or German, in clear and simple wording. Notifications are not to make any reference to internal instructions or contain abbreviations or information which might not be understood by other railway undertakings. The notification is to contain the following information:

1. No. originator and date of the traffic restriction;

2. Reason for the traffic restriction;

3. Destination region(s) affected by the restriction;

If particular stations or, as appropriate, particular consignees are affected by the restriction, they are to be precisely specified. If traffic is suspended over a particular section of line all the stations affected are to be listed.

4. Forwarding region(s) affected by the restriction;

5. Types of traffic affected;

Trainload traffic, groups of wagons, traffic in individual wagons, “combined traffic”, empty wagons.

6. Wagons affected;

Wagons are to be specified exactly, if possible using NHM codes.

7. Duration of the restriction;

The date is to be given in figures using the following format: 2013-07-01.

8. Traffic already consigned;

- will be accepted and moved by the planned route

- is to be diverted via …

- is to be stopped, the consignor is to be asked, as appropriate, to give his instructions. Address and signature of the person issuing the notification. If the duration of the restriction cannot be given immediately, it is to be notified as soon as possible. If a traffic restriction requires amending, it is to be lifted and a new restriction imposed.

4 Means of notification Notifications of traffic restrictions in accordance with point 3 above are to be sent to the undertakings affected by e-mail or by fax.

5 Timescales To allow undertakings affected by a traffic restriction to take appropriate action, traffic restrictions which are planned (e.g. strikes) must be notified at least four calendar days before they are due to take effect.

6 Lifting of a traffic restriction If a traffic restriction is to be lifted, the undertakings affected are to be notified immediately in English, French or German using the following phraseology:

Traffic restriction No .... (number) of ...... (date) notified in notification reference No ...... (number) of ..... (date) is lifted with effect from ..... (date) at ...... (time)/with effect from receipt of this notification. Address and signature of the person issuing the notification.

7 Annual summary of traffic restrictions which are still valid At the end of each calendar year, each railway undertaking is to draw up a summary of the traffic restrictions which it has notified and which are still valid and send a copy to all the railway undertakings affected.

8 List of addresses A list of the railway undertakings’ offices to which notifications of traffic restrictions, of their being lifted and the annual summary of restrictions which are still valid should be sent is published on the CIT website: www.cit-rail.org.
