करारना यातील सवसाधारण अटी शत नुसार काम करण ेठेकेदारास बंधनकारक राहील.

6) ठेकेदारास मंजूर केले या ठे याचे ह कोण याही स, कंपनीस ह तांतर करता येणार नाही अथवा या कामासाठी उप कं ाटदार नमेता येणार नाहीत.

7) य काम करताना रहदारीस अडथळा येणार नाही. नागरीकांना इजा होणार नाही, याची संपूण

जबाबदारी ठेकेदारावर राहील.

8) ठे या या कालावधीम ये ठेकेदाराचे कामगारास ठे याशी संबंिधत काम करतेवेळी इजा/अपघात

झा यास याची जबाबदारी ठेकेदाराची राहील, याची जबाबदारी महापािलकेवर राहणार नाही. याबाबत कामगारांचा िवमा उतरिवणेची जबाबदारी ठेकेदाराची राहील.

9) ठे याचा कालावधीम ये ठे याशी संबंिधत कामामुळे य थप ी (Third Party) स

इजा/अपघात झा यास याची जबाबदारी ठेकेदाराची राहील, याबाबतची जबाबदारी महापािलकेवर

राहणार नाही. याक रता ठेकेदारास य थप ी (Third Party) िवमा उतरिवण े बंधनकारक

राहील.तसेच कं ाट कालावधीत कोण याही कारचा अपघात, दघुटना िजिवत व िव हानी झा यास

यास कं ाटदार जबाबदार राहील, व याब ल कोणतीही नुकसान भरपाई महानगरपािलका कं ाटदारास देणार नाही.

10) कामाबाबत यं सामु ी, सािह य, कामगार ठेकेदाराचे राहील. याबाबत वेगळा आकार दला जाणार

नाही. िनिवदा येत मंजूर झाले या ठकाणी 2.5 फुट ं द x 4 फुट उंच साईज या जािहरातीची उभारणी वखचाने करण ेठेकेदारावर बंधनकारक राहील.

11) िवदयुत खांबावरील जािहरात कऑ क (Kiosk) े म िड हायडर तळा या उंचीपासून 10 फुट इत या तलीय सूट अंतरावर लावण ेठेकेदारावर बंधनकारक राहील.

12) मंजूर ठेकेदारास पोचमागा या िवराम रेषेपासून 25 मीटस या अंतराम ये चौकातील िस ल पोलवर व

ॅफ क िस ल दस यास अडथळा िनमाण होईल अशा पोलवर जािहरात करता येणार नाही. 13) मंजूर ठेकेदारास कािशत जािहरात कऑ कवर वाहतुक िच हाशी िमळते जुळत ेकलर उदा. लाल, अंबर

व िहरवा द शत करता येणार नाहीत.

14) िवदयुत खांबांवर कािशत जािहरात िस द करावयाची अस यास यासाठी लागणारा िव ुत पुरवठा वतं पण े वखचाने करावा लागले. याक रता एमएसईडीसी या िनयमानुसार वतं िवज िमटर

जोडणी घेण ेठेकेदार यांचेवर बंधनकारक राहील. सदरचे देयक थेट एमएसईडीसीकडे वखचाने भरणा करणेची जबाबदारी ठेकेदाराची असेल. ठेकेदाराने घेतले या िवज िमटर देयकास महापािलका जबाबदार राहणार नाही. महानगरपािलकेमाफत कोण याही कारचा िवदयुत पुरवठा केला जाणार

नाही. तसेच कािशत जािहरात िस द करताना िवदयुत पुरवठयासाठी एम.एस.ई.डी.सी./महापािलका/शासना या िनयम/अटी व मानकां माणे कायवाही करण े ठेकेदारावर

बंधनकारक राहील. तसेच िवदयुत िवषयक कामे शासन मा यता ा परवानाधारकाकडून क न घेण े

ठेकेदारावर बंधनकारक राहील.

15) दवाब ीचे खांबांवर जािहरात लावताना अथवा इतर काम करताना दवाब ीचे खांबावरील ट मनल

बॉ सवर उभे रा न जािहरात ठेकेदार कवा यांचे कामगारांस जािहरात कऑ कबाबतचे काम करता येणार नाही. अशा कारे ट मनल बॉ सवर जािहरात ठेकेदार कवा यांचे कामगार जािहरात

कऑ कचे काम करताना िनदशनास आ यास संबंिधत जािहरात ठेकेदार एज सीवर दंडा मक कारवाई

कर यात येईल. दवाब ीचे खांबांवर जािहरात व तदनुषंगीक कामे करणेसाठी िवदयुत वाह रोधक

िशडीचा वापर करावा. 16) कािशत जािहरात कऑ कक रता िवदयुत पुरवठा केबल काम व वाय रग भारतीय मानांकनानुसार

(Bureau of Indian Standards) असावे व याबाबत पुरेशी द ता जािहरात ठेकेदार एज सीकडून

घे यात यावी. केबल ट मनेशन व ट मनल बॉ सचे काम सुरळीत र या क न सुर ा उपाय हणून MCB

वापर यात यावेत. तसेच ट मनल बॉ स ते जािहरात कऑ क पयतचे वाय रग कंि सल व पात

असावे. कोण याही कारचे खुल े कने शन नसावेत. तसेच या िवजपुरवठयामुळे दवाब ी खांबांस

िवदयुत शॉक लागणार नाही याची यो य ती द ता घे यात यावी. याबाबत कोणताही अपघात

घड यास याची सव जबाबदारी संबंिधत ठेकेदाराची राहील.

17) या ठे याअंतगत िवदयुत खांबांचे कोण याही कारचे नुकसान झा यास व तो पुववत क न न दलेस िनिवदेसोबत जमा केलेली ाथिमक सुर ा अनामत र म ज कर यात येईल. तसेच झाललेे नुकसान वसुल कर यात येईल.

कोणतीही ढोबळ, िनटिनटके नसलेली, सुशोिभत नसलेली वाहतुक स अडथळा िनमाण करणारी कोण याही अ य काय ाचे उ लंघन करणारी, धा मक भावना दखुावणारी, समाजाचे नैितक अवमु यन

करणारी, कोणाचेही नावाचा उ लेख क न अ ुनुकसान करणारी कवा रा ीय बोधिच हांचा गैरवापर

होणारी तसेच आयु ां या मते यो य नसलेली व कायदा व सु व थेचा िनमाण करणारी कोणतीही जािहरात ही आ ेपाधीन जािहरात समज यात येईल.

27) महानगरपािलकेस कोणतीही जािहरात काढणे आव यक वाट यास महानगरपािलकेने नोटीस

द यापासून चोवीस तासाचे आत सदरची जािहरात काढणे ठेकेदारावर बंधनकारक असेल. सदर

जािहरात ठेकेदाराने न काढ यास ती महानगरपािलकेकडून काढ यात येईल. मा ती काढणेकामी येणारा सव खच व जबाबदारी ठेकेदाराची असेल. महानगरपािलकेन ेसदर खच के यास तो संपुण खच

ठेकेदाराकडून वसूल कर यात येईल.तसेच अशा कारे महानगरपािलकेन े काढले या जािहराती या बद यात कोण याही कारची नुकसान भरपाई माग याचा ठेकेदारास अिधकार राहणार नाही, ठेकेदारास कोण याही व पात नुकसान भरपाई दली जाणार नाही व अ य िहतसंबंधीता या सव

त ारीचे िनवारण कं ाटदार वखचाने व वजबाबदारीवर करेल.

28) ठेकेदाराने लावले या िव ुत खांबावरील जािहरात कऑ कमुळे इतर कोणतेही अनुिचत कार घड यास

यास ठेकेदार जबाबदार राहील. तसेच वरील माण े केले या सव कायवाही पासून कवा कोण याही यायालयीन करणापासून महानगरपािलकेस अिल ठेव याची जबाबदारी ठेकेदाराची असेल.

याकामी होणा-या सव खचास व नुकसानीस ठेकेदार जबाबदार असेल.

29) ठेकेदार या दारे महानगरपािलकेस सव कारचे दावे, कारवाई, माग या, नुकसान, खच, आकार

इ यादीपासून अिल ठेव याची हमी देत आह.े तसेच या करारातील तरतदुीनुसार जािहरात फलकावर

जािहरात लावणेचा अिधकार वापरीत असताना कोणताही दावा अस यास कवा कोण याही ुटीस

आ हान दल ेगे यास कवा कोणताही हानीकारक कवा अ ुनकुसान करणारा मजकुर िस द के यास

व कायदा व सु थेचा िनमाण झा यास याकरीता ठेकेदार जबाबदार राहील. िन रिनराळया शासक य/िनमशासक य ािधकरणांना दयावा लागणारा कर अथवा दंड भर याची जबाबदारी ठेकेदारावर असेल.

30) या कराराची अंमलबजावणी चाल ू असताना जर संप,टाळेबंद,सािह याची कमतरता,यु द,आग, पुर,भुकंप, वादळ, वालामुखी व अ य नैस गक आप ी, शासनाने केले या अ य काय ामुळे जर

महानगरपािलकेस या कराराची अंमलबजावणी करण े अश य झा यास अशा प रि थतीत ठेकेदारास

महानगरपािलकेकडून कोण याही कारची नुकसान भरपाई मागणेचा ह वा अिधकार राहणार नाही. 31) करारा या कालावधीत ठेकेदाराने कमान सहा मिह यांची नोटीस द यािशवाय ठेका सोडता येणार

नाही. अशा करणी ठेकेदाराने वषा या सु वातीला महानगरपािलकेस भरललेी र म (Security

Deposit) परत दली जाणार नाही. 32) िनिवदाधारकाने मंजूर झाले या िनिवदा माणे जािहरातीपोटीची र म ितमाही प दतीन े आगाऊ

व पात महानगरपािलका कोषागारात ितमािह या पिह या मिह या या 10 तारखेपयत जमा करण े

बंधनकारक राहील. अ यथा सदर तारखेनंतर अशा र मेवर ितमहा 10% दरान े िवलंब शु क

आकारणेत येईल.

33) करार कालावधीत ठेकेदाराकडून महानगरपािलकेस येण े असलेली कोण याही व पाची र म ही कं ाटदारास नोटीस िमळा यापासून 15 दवसांत महानगरपािलकेस न भर यास ती िमळकत कराची थकबाक समजून महारा महानगरपािलका अिधिनयम 1949 या तरतुदीनुसार स या मागान े

वसूली केली जाईल.

34) ठेकेदाराने कोणतेही दवाळखोरीचे कृ य के यास कवा यास कोण याही यायालयाने दवाळखोर

घोषीत के यास कवा याने वसाय स न े बंद करण ेबाबत यायालयाचा आदेश अस यास अथवा याने वसाय बंद करण े बाबत वैध र या ठराव केललेा अस यास कवा या कराराचे तरतदुीनुसार

महानगरपािलकेन े ा केले या ज ीची अंमलबजावणी श य होत नस यास, तसेच ठेकेदाराने या करारातील कोण याही अटीशत ची पुतता केली नस यास महानगरपािलकेस ततुचा करार कोणतीही नो टस न देता र करता येईल. तसेच अशा कारे करार र के यानंतर महानगरपािलकेची ठेकेदाराकडून येण े असललेी र म वसुल कर या या अिधकारावर कोण याही कारची बाधा येणार

नाही. तसेच वरील प रि थतीत महानगरपािलका ठेकेदाराकडून नुकसान भरपाई माग ू शकेल. तसेच

ठेकेदाराने महानगरपािलकेचा िव ासघात/फसवणुक केली हणून महानगरपािलका याकरीता कायदेशीर कारवाई क शकेल.

35) िनिवदाधारकाने िनिवदा भरताना या र यावरील िनिवदा भरावयाची आह े या र यावरील पोलची पूण पहाणी क न िनिवदा सादर करावी. त तंर याब लची कोणतीही त ार िवचारात घेतली जाणार

36) करार कालावधीत िनिवदेमधील िविश भागातील िव ुत खांबांची सं या वाढ यास, या मिह यापासून वाढले या खांबासाठी िनिवदेतील मंजूर पोल तीमहा दरानुसार जािहरातीपोटीची र म देय राहील.

37) ठे यातील कोण याही र यावरील पोलचा ठेका, कोण याही कारणासाठी ठे या या कालावधीत र

कर याचे अिधकार महापािलका आयु यांनी वत:कडे राखून ठेवल ेआहते. याबाबत महापािलकेमाफत

कोणतीही नुकसान भरपाई ठेकेदास दे यात येणार नाही. तथापी याबाबत ठेकेदारास महापािलकेमाफत

01 मिह याची आगाऊ नोटीस बजावण ेआव यक राहील.

38) ठेका मंजूर झाले या ठेकेदारास ठे याचे कामकाज करणसेाठी नवी मंुबई महापािलका कवा एमएमआरडीए काय े ात कायालय कायाि वत करावे लागले.

जुलै, 2017 पासून राvामnे व�ु व सेवा कर (GST) लागू झालेला आहे. &ामुळे िनिवदाकाराने िनिवदा सादर करताना व�ु व सेवा कर (GST) वगळून िनिवदा देकाराची र0म भरणा करावी. ठेका र0मेवरील

व�ु व सेवा कर (GST) शासनाकडे भर8ाची जबाबदारी ठेकेदाराची राहील. तसेच ठेका र0मेवरील व�ु व

सेवा कर (GST) शासनास .दान केलेबाबतचा साांिकत अहवाल वेळोवेळी महापािलकेकडे सादर करणे

and thereafter until it is withdrawn by me/ us by notice in writing duly addressed to the authority

Notice. The amount of earnest money may be adjusted towards the security deposit or refunded to me

/us if so desired by me/us in writing, unless the same or any part thereof has been forfeited as aforesaid.

Should this Tender be accepted I/ we hereby agree to abide by and fulfill all the terms and provisions of

4.1 Intending Tenderers will be allowed to seek clarification and suggest suitable

are so communicated shall be binding on the Corporation and all the Tenderers.

4.2 The Tenderer should get its doubts cleared during pre-bid meeting only, if provided in

the Tender. In case no pre-bid meeting is to be held, the Tenderer should seek

clarification of any doubt in writing seven (7) days before the last date for receipt of

Tenders.

6.1 The Tenderer shall deposit the amounts indicated in the Tender Notice as Earnest

Money Deposit (EMD)., The Earnest Money shall be deposited in the form a demand

draft / pay order in favour of ‘Navi Mumbai Municipal Corporation’. The failure or

omission to deposit the Earnest Money shall disqualify the Tender and the Corporation

shall exclude from its consideration such disqualified Tender(s). No interest shall be

payable by the Corporation in respect of such deposited Earnest Money.

The Tenderer can also deposit EMD through Payment Gateway available at E-tendering

Website www.nmmcmaharashtra.etend ers.in.

Alternatively The Tenderer can also deposit a Fix EMD at NMMC office which will be

credited to his account.

6.2 If the Corporation accepts the Tender, the Earnest Money shall be appropriated

towards Security Deposit payable by the Tenderer in accordance with the Conditions of

Contract. Alternatively on payment of the required amount of the Security Deposit and

the execution of the Contract Agreement,the Earnest Money shall be returned to the

Tenderer.

7.1 The Tenderer shall not revoke his Tender or vary its terms and conditions without the

consent of the Corporation during the validity period of Tender, failing which the

Earnest Money deposited by it shall stand forfeited to the Corporation without

prejudice to its other rights and remedies and the Tenderer shall be disentitled to

submit a Tender to the Corporation for execution of any work during the next twenty-

four (24) months effective from the date of such revocation.

7.2 If the successful Tenderer does not pay the Security Deposit in the prescribed time

limit or fails to sign the agreement bond, The Earnest Money Deposit will be forfeited

by the Corporation.

8.1 The Earnest Money of unsuccessful Tenderers shall be refunded after the successful

Tenderer furnishes the required Initial Security Deposit to the Corporation and signs

the Contract Agreement or within thirty (30) days of the expiry of validity period of

Tenders, whichever is earlier.

9.1 The Tenderer shall bear all costs associated with the preparation and submission of its

Tender. The Corporation shall in no case be responsible or liable for these costs,

regardless of the conduct or the out come of the Tendering Process.

10.1 Only those Tenderers who fulfill the eligibility criteria as mentioned in Schedule CSchedule CSchedule CSchedule C of

the Tender Notice are eligible to submit their Tenders for this work. The documents

indicated against each of the eligibility criteria shall be required to be submitted along

with the technical bid to establish the eligibility of the Tenderer.

10.2 The Corporation shall usually hold a Tenderer eligible for the Tender subject to the

condition that the price tendered by him together with the value of outstanding work/

contracts under execution by him for the Corporation or any other employer shall not

be more than four times the value of average annual turnover of works / contracts

executed during the preceding three financial years ending 31st March.

The Tenderer shall not be associated presently or in the past with any of the office

bearers of Corporators of Navi Mumbai Municipal Corporation, either directly or

indirectly as specified in the section 10(f), (g) of BPMC Act. 1949. The Tenderer shall

furnish an affidavit on a Non-Judicial stamp paper of Rs.100/-. If any information so

furnished shall be found to be untrue or false, the Tenderer shall be liable to be

disqualified and the Earnest Money accompanying such Tender shall stand forfeited to

the Corporation. If the Information so furnished shall be found to be untrue or false

during the currency of the contract, the Tenderer shall be held to be in default and the

Contract if any awarded to it shall be liable to be terminated with its consequences.

The Tenderer is expected to work out their own rates based on the detailed description

of items, the specifications, drawings and conditions and finally arrive at the cost of the

Work/Service in the appropriate place. The Tenderer shall be deemed to have satisfied

itself before tendering as to correctness and sufficiency of its Tender. The rates and

prices quoted shall, except as otherwise provided, cover all its obligations under the

contract and all matters and things necessary for proper completion and maintenance

of the Works/Services.

Where necessary, before submitting its Commercial Bid the Tenderer should inspect

and examine the site and its surroundings and shall satisfy itself about form and nature

of the Site, the quantities and nature of the Work/Service and materials necessary for

the completion of the Works/Services, means of access to the site, the accommodation

it may require, and in general, obtain all necessary information as to risk, contingencies

and other circumstances which may influence or affect its Tender. No extra charges

consequent on any misunderstanding or otherwise shall be allowed.

14.1 Tenders shall be received as specified above not later than the time and date specified

14.2 The Corporation may, as its discretion, extend this deadline for submission of Tenders

by amending the Tender Documents, in which case all rights and obligations of the

Corporation and Tenderer will thereafter be subject to the deadline as extended.

14.3 Any Tender received by the Corporation after the deadline for submission of Tender prescribed

by the Corporation, pursuant to the clause above, will be rejected and /or returned unopened to

the Tenderer.

The Tenderer may modify or withdraw its Tender after its submission, provided that a written

a) The financial bid shall be inclusive of all taxes, Octroi, Local taxes, etc. to be paid

by the Tenderer for the Work/Service and any claim for extra payment on any

such account shall not be entertained. b) No alterations or additions anywhere in the Tenderer Document are permitted. If any of

these are found, the Tender may be summarily rejected.

c) In case of a firm, each partner or power of attorney holder shall sign the Tender and the

signatures shall be attested as witness by a reputed person in the space provided for the

purpose. The attested copies of power of attorney of person signing the Tender shall be

enclosed with The Tender. The power of attorney shall be signed by all partners.

In case of Private limited /public limited companies, the power of attorney shall be

supported by Board Resolution and appropriate and adequate evidence in support of the

same shall be provided.

d) All pages and pasted slips should be signed by the Tenderer. Corrections, if any,

must be signed

e) No page shall be added or removed from the set of Tender Document.

f) The Tenderer shall submit the Tender which satisfies each and every condition

laid down in this Tender Document, failing which the Tender will be liable to be

18.1 The Corporation requires that the Tenderer under this Tender observe the highest

standards of ethics during the procurement and execution of such Contracts. In

pursuance of this policy, the Corporation defines for the purposes of this provision, the

terms set forth as follows :

a) “Corrupt Practice” means the offering, giving, receiving or soliciting of any thing

of value to influence the action of the public official In the procurement process

or in contract execution; and

b) “fraudulent practice” means a misrepresentation of facts in order to influence a

procurement process or a execution of a contract to the detriment of the

Corporation, and includes collusive practice among Tenderers (prior to or after

Tender submission) designed to establish Contract Prices at artificial non-

competitive levels and to deprive the Corporation of the benefits of the free and

open competition.

18.2 The Corporation will reject a proposal for award if it determines that the Tenderer

recommended for award has engaged in corrupt or fraudulent practices in competing

for the Contract in question; The Corporation will deem a firm ineligible, either

indefinitely or for a started period of time, to be awarded a Contract if at any time it

determines that the firm has engaged in corrupt and fraudulent practices in competing

for, or in executing, a Contract

Authority of Tender Committee and E-tendering Administrator.

Information relating to the examination, clarification, evaluation and comparison of

Tenders and the award of a Contract shall not be disclosed to Tenderers or any other

person not officially concerned with such process until the award to the successful

Tenderer has been announced.

21.1 The Corporation will scrutinize the Tender to determine whether they are complete,

whether any errors have been made, whether required technical documentation have

been furnished, whether the documents have been properly signed, and whether the

Tenders are generally in order. The Corporation will also determine the substantial

responsiveness of the Tender. For purpose of these clauses, a substantially responsive

Tender is one that confirms to all the terms and conditions of the Tender Documents

without material deviations. The Corporation’s determination of an Tender’s

responsiveness is to be based on the contents of the Tender itself without recourse to

extrinsic evidence.

21.2 A Tender determined as not substantially responsive will be rejected by the

Corporation and may not subsequently be made responsive by the Tenderer by

correction of the non-conformity. The Corporation may waive any minor infirmity or

irregularity in a Tender which does not constitute a material deviation. This shall be

binding on all Tenderers and the Corporation reserves the right of such waivers.

To assist in the scrutiny, evaluation and comparison of Tenders, the Corporation may,

at its discretion, ask some or all Tenderer for technical clarification of their Tender. The

request for such clarifications and the response shall be in writing. To speed up the

Tender process, the Corporation, at its discretion, may ask for any technical

clarification to be submitted by means of facsimile by the Tenderer. In such cases,

original copy of the document describing the technical clarifications must be sent to the

Corporation by means of courier/in person.

The Corporation shall notify the date of opening of the Financial Bids to all the

Acceptance of Tender on behalf of the Corporation shall be done by an officer(s) to

whom the powers are delegated by the Municipal Commissioner. The Corporation is

not bound to accept the lowest or any Tender. The right to split up the Work/Service in

two or more parts is reserved by the Corporation and also the right to award the

Work/Service to more than one agency is reserved. The Corporation reserves the right

to reject any or all Tenders received without assigning any reason whatsoever.

The acceptance of Tender may be communicated to the successful Tenderer in writing

or otherwise either by the Tender opening authority or any authority in the

Corporation.

26.1 Successful Tenderer shall pay a Security Deposit equal to the Amount indicated in the

Schedule A of the Detailed Tender Notice as security for due fulfillment of the contract,

within seven (7) days after receipt of intimation in writing of acceptance of Tender.

26.2 The mode of making this deposit is as under.

It is optional to the Tenderer to make the initial Security Deposit in any one of the

Scheduled Banks in the enclosed format or

shall be recovered from the Tenderer’s running bills at the rate of five (5) percent

and such retention together with the Initial Security Deposit made as aforesaid

27.1 The successful Tenderer after furnishing the Initial Security Deposit, is required to

execute an Agreement in duplicate in the form attached with the Tender Documents on

a stamp paper of proper value. The proper value at present is Rs.100/- The Agreement

should be signed within 15 days from the date of acceptance of the Tender. The

Contract will be governed by the Contract Agreement, the Conditions of the Contract

(CoC) and other documents as specified in the CoC.

27.2 It shall be incumbent on the successful Tenderer to pay stamp duty for the Contract

Agreement, as applicable on the date of the execution.

Wherever relevant, before commencing the Work/Service the successful Tenderer

shall be required to produce to the satisfaction, of the Corporation a valid Contract

Labour License issued in its favour under the provision of the Contract Labour

(Regulation and Abolition), Act 1970. On failure to do so, the acceptance of the Tender

is liable to be withdrawn and also the Earnest Money is liable to be forfeited.

29.1 The Corporation reserves the right to suitably increase/ reduce the scope of work put

to this Tender. In case of a Rate Contract, the Corporation does not in any way

guarantee the quantity for which an order may be placed and the Tender quantity may

only be treated as indicative.

29.2 In case of any ambiguity in the interpretation of any of the clauses in Tender Document

or the Contract Document, interpretation of the Clauses by the Corporation shall be

final and bindings on all Parties.
