TAMIL NADU FOR 2012-2013 SEASON (OCTOBER 2012 TO SEPTEMBER 2013)
1. SUBMISSION OF TENDER: Manufacturers who have either own / leased ki ln alone are el igible to submit tender. They should submit documentary evidence, having own / leased ki ln from the respect ive State Government authority. Tender should be submitted in two parts (Part I containing technical and commercial offer and part II containing Price offer) in separate sealed covers to the Tamil Nadu Cooperative Sugar Federation in person or by post. The cover containing EMD should be superscr ibed as EMD in the cover. The Part I tender should accompany the fol lowing documents : a)

OPENING OF TENDER:
Sealed Tender Part I "Specificat ion and Commercial Terms" wil l be opened by the Tender Accepting Authority at the office of Tamil Nadu Co -op Sugar Federation at 03.30 P.M on 10-09-2012. in the presence of the tenderers or their authorised representatives. Part II "Pr ice offer" wil l be opened after scrutiny of specif ications and commercial terms on the date and time to be intimated on the opening day of the Part -I tender. 3. VALIDITY OF OFFER: Tenderers should keep their offer valid for acceptance upto 31.1 2.2012. 4. EARNEST MONEY DEPOSIT: Each tenderer should furnish E.M.D. for a sum of Rs.2 lakh by way of D.D./Banker Cheque in favour of Tamil Nadu Cooperative Sugar Federation Limited, on any Nat ional ised Bank Payable at Chennai (Madras) along with the tender. Tenders without EMD in any of the above forms wil l be summari ly rejected, provided that any category of tenderers specifically exempted by the Government from the payment of EMD are not required to make such a deposit subject to the production of suitable evidence. In the case of successful tenderers, the Earnest Money Deposit remitted by them wil l be refunded only after satisfactory completion of the supply of the entire quant ity of l ime to the Sugar Mil ls. In case of unsuccessful tenderers, the Earnest Money Deposit wi l l be refunded within one month from the date of finalisation of the tender. The Earnest Money Deposit carrys no interest. 5. SECURITY DEPOSIT: The successful tenderer should remit 3% of the total value of the contract towards security deposit by way of Demand Draft / Banker's cheque in favour of Tamil Nadu Cooperative Sugar Federation Ltd., within 7 days from the date of receipt of f irst communication of the acceptance of the tender from Tamil Nadu Co-op Sugar Federation. Only after receipt of the Security Deposit, orders for f ixation of rate contact wil l be issued by the Federation. Any fai lure to remit the Security Deposit wil l entai l terminat ion of contract besides forfeiture of E.M.D. The Security Deposit wil l be refunded only after satisfactory completion of entire ordered quantity of l ime to al l the mil ls. The Security Deposit Carri es no interest.
/ 3 / 6. SPECIFICATION: a. Burnt stone l ime should contain 75% CaO. In case, it fal ls below
75 % deduction wil l be made from the supply bil l at the rate of 2.5% of total cost (landed cost) for every 1% decrease upto 70%. If the CaO content fal ls below 70%, 4% of total cost wil l be deducted for every 1% decrease below 70% and upto 65%. If the CaO content fal ls below 65%, the l ime wil l be rejected and such consignment should be removed from the mil l site by the supplier at their own cost/risk.
If the CaO content of the l ime is above 75%, addit ional payment at the rate of 1% of the total cost wil l be made for every 1% increase in CaO content above 75% .
b. The grit content should be below 8% of the weight of the l ime. If the
grit content is between 8% and 10%, the rate wil l be reduced by 1.5% of the total cost for every 1% increase beyond 8%. If the grit content is above 10%, the rate wi l l be reduced by 3% of the total cost for every 1% increase above 10% and upto 12%. If the grit % exceeds 12% the l ime wil l be rejected and such consignment should be removed from the mil l site by the supplier at his own cost / r isk.
c. If the suppliers fai l to remove the rejected loads no payment including freight wil l be made.
d. The burnt stone l ime should not contain any colouring matters and, the prepared Milk of Lime should be milky white.
7. (a) ELIGIBILITY OF TENDERS :
1. The tenderer should have suppl ied the Lime to the major customers including sugar mil ls in India for 2 sugar seasons after 1.10.200 8. Evidence should be produced.
2. The tenderer should have a business turnover of atleast Rs.50 lakhs
(Rs. Fifty Lakhs ) per annum.
3. The tenderer should have a Manufacturing / leased kiln Capacity of Minimum 300 MT/per month/per mil l to meet the requirement. (certi f icate to be enclosed).
4. The tenders which do not sat isfy the above criteria wi l l be rejected.
7. (b) EVALUATION OF TENDERS
1. The evaluation of price tender shall include al l central duties such as customs duty and central excise duty and sales tax as a part of the price as detailed below:
/ 4 / (i) In evaluation of the price of an imported item, the price wil l be
determined inclusive of the customs duty. (i i) In evaluation of the price of articles which are subject to excise duty, the
price wil l be determined inclusive of such excise duty. (i i i ) If al l the tenderers are from within the State of Tamil Nadu, or where al l
the tenderers are from outside the State of Tamil Nadu, the sales tax shal l be included for the evaluat ion of the price; and
(iv) If the tenderers are both from the State of Tamil Nadu as wel l as from
outside the State of Tamil Nadu, the sales Tax under the TNGST Act, 1959 shall be excluded for the evaluation of the price.
2 Price preference of fifteen percent for domest ic smal l scale industrial unit and ten percent for the Public Sector Undertakings of the Govt. in respect of products and qualit ies manufactured by them.
3 Performance of the tenderer during previous years regarding
observance of quality and other terms and condit ions of the contract wi l l also be taken into account while evaluating the tenders.
4 The Burnt Stone Lime samples supplied along with the tender should
satisfy the specificat ion given in the terms and condit ions of the tender. 8. PACKING & FORWARDING: The L ime should be bagged in high -density polythene bag on non-returnable basis. Packing should conform to the standards prescr ibed by the Carriers and the Insurers to facil itate claim on them, in case of damages in transit. 9. INSURANCE: The Lime should be transported through reputed and rel iable carriers for prompt del ivery at respective mil ls ' s ite with ful l insurance for transit risk. 10. DELIVERY : Suppliers should strict ly adhere to del ivery schedule of the individual sugar mil ls. The delivery should not be delayed on any account. If there is any delay, the suppl ier should inform both the Federation and the concerned Sugar Mil ls by FAX/telegram wel l in advance, for making alternative arrangements. If there is delay for more then 3 days, the Federation/ concerned mil l reserves the right to cancel the order in Part or in full and the supplier shal l be l iable to compensate al l the losses sustained by the purchaser in this regard. 11. QUANTITY : This tender is only for fixing a rate contract. The quantity r equired is approximately 17215 MTs. The sugar mil ls concerned wi l l place order directly for the exact quantity required.

12. QUALITY & PURITY: The Lime to be supplied should be strict ly of high qual ity conforming to the specifications la id down in the tender and to the sample produced by the supplier along with the tender. If the quality of the material is not upto the mark, the materials are l iable for reject ion, besides the recovery of different ial cost from the supplier for the alternative arrangement to be made by us. 13. PRICE: a) Price shall be quoted in the enclosed proforma on the basis of
delivery at individual sugar mil l site inclusive of freight and forwarding charges and unloading charges 'C ' Form wil l be issued on request from suppliers for inter -State transact ion. The basic price, rate of taxes and duties, transport charges and others if any, should be specif ied. The supplier should raise single invoice including transport charges and taxes etc., for getting payment. No separate invoice for transport charges is al lowed. Part payment wil l be paid to the transporter, i f the supplier is authorized the transporter in their letter head for the payment of transport charges.
b) The price shall be fi rm and no escalation is permitted. If there
is any variation in statutory levies (l ike Sales Tax and other Government levies), after acceptance of the tender, but prior to the date of deliveries, the corresponding variation in price can be mutually settled between the purchaser and seller.
c) This is only a rate contract. Firm order wil l be placed by the individual
sugar mil l based on the rate final ised by the Tamil Nadu Coop. Sugar Federation.
d) If the tenderer supplies l ime of same specificat ion to any other mi l l
at a lesser rate, the same wi l l be applicable to cooperative sugar mil ls in Tamil Nadu as wel l.
14. PAYMENT: 95% of the total value wil l be paid by the Sugar Mi l l s within 15 days of receipt of materials. The balance 5% wil l be paid after completion of supply as per the terms and condit ions of the tender, after analysing its quality at Mi l ls ' Lab. Lime loads shall be weighed at our factory's we igh bridge alone and payment wil l be determined on the basis of the weight and quality of l ime. The test reports of Mil ls ' lab shal l be final and binding on the suppliers. 15. PENALTY: If there is any delay in del ivery of the supply withi n the scheduled period of delivery, supplier should pay a penalty at 1.5% of the total value ( landed cost) for every days delay, beyond 3 days from the scheduled date of supply, subject to a maximum of 5%. This amount wi l l be deducted while making payment to the supplier.

16. AGREEMENT: The supplier should execute an agreement with the individual mi l l for fulfi lment of the contract in the non -judicial adhesive stamp paper valued at Rs.20/- in the prescribed form within 10 days from the date of receipt of Purchase Orders from the mil ls. 17. RIGHTS OF THE TENDER ACCEPTING AUTHORITY: The Tender Accepting Authority of Federation reserves the right to accept or reject any tender without assigning any reason therefor and restrict the quant ity of total production capacity of the tenderers for placement of orders. 18. JURISDICTION OF COURT: For any dispute ar ising out of this contract, the jurisdict ion wil l be with the court in whose terr itory the m il l is located. 19. Applicability of Tamil Nadu Transparency in Tender's Act & Rules.
The Tamil Nadu Transparency in Tender's Act 1998 and the Rules made thereunder for the time being in force shall apply to the tender.
