No. 8'l(Go -F.RS-17-XIII-2002 : In pursuance of the provisions of section 133
of the Electricity Act, 2003 (No. 36 of 2003), section 24 of the Madhya
Pradesh Vidyut Sudhar Adhiniyarn, 2000 (No. 4 of 2001) read with the
Madhya Pradesh Electricity Reforms First Transfer Scheme Rules, 2003
(hereinafter referred to as the First Transfer Scheme Rules) and the Madhya
Pradesh Electricity Reforms Transfer Scheme Rules, 2006 and all other
applicable provisions of law and after due consultation with the concerned
entities, the Government of Madhya Pradesh hereby Order to give effect to the
transfer of personnel of the Madhya Pradesh State Electricity Board
(hereinafter called "the Board") to successor entities on the following terms
and conditions, namely :-
1. (1) In this order, unless the context otherwise requires,-
(a) "Apex Committee" means the Apex Committee constituted under clause 6 of this Order;
(b) "Effective Date" means the date of the publication of this order in the official Gazette;
(c) "Working Committee" means the working committee constituted to assist the Apex Committee in terms of clause 5 of this Order.
(2) The other expressions used in this order shall have same meaning
as assigned to them in the Electricity Act, 2003, (No. 36 of 2003), the Madhya
Pradesh Vidyut Sudhar Adhiniyam, 2000 (No. 4 of 2001) and the Madhya
Pradesh Electricity Reforms First Transfer Scheme Rules, 2003 and the
Madhya Pradesh Electricity Reforms Transfer Scheme Rules, 2006.

2. Transfer of Personnel:
The services of the personnel of the Board assigned to and working as
on the date of this Order in Discom-1, Discom-2, Discom-3, Genco, Transco
and Tradeco shall stand transferred on a provisional basis to the said entity
in which they are working as on 'the date of this Order subject to the terms
and conditions contained in this Order:
Provided that a personnel who has been working in any entity on the
Effective Date on a temporary basis by virtue of an order passed by the Board for such temporary assignment prior to the Effective Date, would stand transferred on a provisional basis to Discom-1, Discom-2, Discom-3, Genco, transco or Tradeco, as the case may be, to which he would have been
assigned but for such temporary assignment:
Provided further that the services of personnel listed in Schedule 'A' to
this Order shall stand provisionally transferred to Genco, notwithstanding
that they have been discharging the functions in any other entity:
Provided further that the services of the personnel working in the
offices listed in Schedule 'B' to this Order shall stand provisionally
transferred to the entity mentioned against the said offices, notwithstanding
any of the provisions mentioned above:
Provided also that in case of any dispute or difference as to the
assignment and transfer of personnel under this clause, including with
reference to any of the provisos, 'the decision of the Government of Madhya
Pradesh, by issuing an order for the said purpose, shall be final.
3. Deputation:
Notwithstanding the transfer on a provisional basis, the Board in
consultation with the entity to which the personnel has been transferred, at any time, may direct deputation of any personnel to work in any other entity
for such period as it may consider appropriate, and on such direction by the

Board, the personnel will be required to serve the entity to which he is
deputed, without any deputation or additional allowance. Such deputation
will not in any manner affect the transfer of such personnel in terms of clause
2 above.
4. The Board shall continue to deal with the service matters, including
promotion on common gradation lists, · of the personnel provisionally
transferred in terms of clause 2 hereinabove till further orders of the
Government of Madhya Pradesh.
5. Apex Committee and WorJ:t~ng Committee:
The Government of Madhya Pradesh shall after due consultation with
Discom-1, Discom-2, Discom-3, Genco, Transco, Tradeco and the Board
constitute an Apex Committee and a Working Committee with powers,
functions and duties as more fully set out in Schedule 'C' and 'D' respectively
to this Order.
6. Representation by Personnel:
(1) The personnel shall have an opportunity to submit their representation
in the prescribed form, as given in Schedule 'E' of this Order, to the Secretary
of the Board in regard to their transfer or any matters relating to their transfer
within 45 days from the Effective Date giving details of their claim to be
considered by the Government of Madhya Pradesh based on the
recommendations of the Apex Committee assisted by the Working Committee.
(2) The Secretary of the Board shall forward the representation received
from the personnel to the Apex Committee for its consideration. The Apex
Committee shall forward its reasoned and cogent recommendations on the
representations made by the personnel to the Government of Madhya Pradesh
within such time as may be allowed by the Government of Madhya Pradesh.
The Apex Committee shall take assistance of the Working Committee for
finalizing recommendations on the representations made by the personnel.

(3) While considering the representation of the personnel and making recommendations, the Working Committee and the Apex Committee shall duly
take into account the suitability, ability and experience of the personnel, and all other relevant factors giving due weightage to career prospects and the
representations of the personnel.
(4) The Working Committee orfhe Apex Committee, as the case may be,
may decide to hold a meeting to hear thE; personnel on their representation at
such place and at such time and in such manner as the Apex Committee may
decide. The personnel shall be entitled to take assistance from the representatives of the Employees Association or Unions of the Board, as the
case may be, during such meetings.
7. Decision on Representation:
(1) The Government of Madhya Pradesh shall decide the representation
made by the personnel taking into account the recommendation of the Apex
Committee and make such order as it considers appropriate on the
representation with regard to the transfer of personnel from the entity to
which they are provisionally transferred to any other entity.
(2) The Government of Madhya Pradesh shall upon finalizing its decision
on the representations, issue appropriate orders in regard to the transfer and
permanent absorption of the personnel provisionally transferred in terms of
clause 2 hereinabove. Such order shall be in terms of sub-rule (6) of rule 7 of
the First Transfer Scheme Rules.
8. Deputation after permanent absorption:
Notwithstanding the transfer and permanent absorption in terms of this
order, the Government of Madhya Pradesh in consultation with the entity to which the personnel has been transferred, at any time, may direct deputation
of any personnel to work in any other entity for such period as it may consider
appropriate and on such direction by the Government of Madhya Pradesh, the

personnel will be required to serve the entity to which he is deputed, without
any deputation or additional allowance. Such deputation will not in any
manner affect the transfer and permanent absorption of such personnel.

(b) The Chairman and the Secretary of the Madhya Pradesh State Electricity Board shall be the Chairman and the Convenor of the Apex Committee respectively.
2. Terms of reference.
(a) In respect of representations received from the personnel against their provisional transfer i.e. before their absorption in the company, the Apex Committee shall, with assistance of the Working Committee make reasoned and cogent recommendations to the Government of Madhya Pradesh.
(b) The Apex Committee shall set out guidelines for this purpose.
