Terms and condition

1. Method of application: Technical bid page along with mentioned attachments and properly

sealed financial bid should be submitted in a bigger sealed envelope clearly stating “Bid for

carrying out works at Vadodara District” and should reach the office personally or through

registered post / courier.

કવરમા ં“Financial Bid “ સાથે એક બીજા મોટા બધં કવરમા ંરાખીને બરુ અથવા રજી ટર પો ટ / કુિરયર

થી મોકલવાનો રહશેે. આ બધં કવર ઉપર “ Bid for carrying out Civil works at Vadodara District”

દશાર્વવાના ંરહશેે.

2. Purpose of this tender: This tender is to invite bids for selecting agency willing to carry out

various works at Different Talukas Chhotaudepur District , few of which are indicated in this

document, at a specified percentage of SOR at the indicated work sites.

આ ટ ડર હ :ુ આ ટેન્ડર એવી રસ ધરાવતી એજન્સીઓ, કે છોટાઉદેપરુ જી લાના તાલકુાઓમા ં

આવેલ આ િવભાગ હઠેળની રેન્જમા ં સીવીલ કામ કરવા ઈચ્છા ધરાવતી હોય, પાસેથી બીડ

આમિંતર્ત કરવામા ંઆવે છે.

3. Who can apply: Any person / agency fulfilling following criteria can apply

a. Valid PAN card number (Copy to be submitted)

b. Should have executed similar works in any government department (Copy of work

order to be submitted)

Should have a turnover more than Rs 5,00,000/- in any of the two last financial years. (Copy

of IT return to be submitted) And priority will be given to the experience into the Civil Work

4. Tender fee (ટેન્ડર ફી) : Rs 500/- by any mode like Cash, BD, DD etc.

ટેન્ડર ફી : .૫૦૦ / - કેશ, બીડી, ડીડી વગેરે વી કોઇ પણ પર્કાર ારા રજુ કરવાનુ ંરહશેે.

5. EMD: Refundable Earnest Money Deposit of Rs 50,000/- will have to be deposited along

with the application in form of Demand draft or Bank Draft issued by a scheduled bank. The EMD

will be retained till the process is over or one month whichever is early.

EMD : ા. ૫૦,૦૦૦/- (અંકે િપયા પચાસ હજાર પરુા) િરફંડપાતર્ બાનુ ં િડપોિઝટ - િડમાન્ડ ડર્ાફટ

અથવા અનસુિૂચત બેંક ારા જારી િડમાન્ડ ડર્ાફ્ટ અથવા બેંક ડર્ાફ્ટ વ પે અરજી સાથે જમા કરવાનુ ં

રહશેે. EMD એક મિહનો અને જયા ંસધુી પર્િકર્યા ચાલ ુ રહ,ે બનં ેમાથંી ઓ હોય ત્યા ંસધુી

જાળવી રાખવામા ંઆવશે.

6. The payment will be calculated based on the actual work executed and the percentage

indicated. Example if the percentage of the successful bidder is 110% and the estimated amount of

the work as per the Technically Sanctioned estimates is 30,000/- then the admissible payment for

that work would be Rs 33,000/-.

ચકુવણાની રકમ ખરેખર કામનો જથ્થો, SOR અને નકકી થયેલ ટકાવારી પર્માણ ેનકકી કવરામા ં

આવશે. દા.ત. જો સફળ એજન્સીનુ ંનકકી થયેલ દર ૧૧૦ ટકા છે અને કામગીરીનુ ંતાિંતર્ક મજુંરી

મળેલ એ ટીમેટની રકમ . ૩૦,૦૦૦/- હોય તો એજન્સીને તે કામ માટે ા. ૩૩,૦૦૦/- મળવાપાતર્

રહશેે.


7. The payment will be released as soon as possible but since it is dependent on availability of

grant from higher offices no firm commitment can be given for the same.

ચકુવણા ં માટે રજુ થયેલ બીલ/વાઉચર, ચકુવણા ં ફંડની ઉપલબ્ધતાને આધીન શક્ય ત્વરાએ

કરવામા ં આવશે, ચકુવણુ ં ફંડની ઉપલબ્ધતા પર આધાિરત હોવાથી આ માટે કોઇ બાહધેરી

આપવામા ંઆવતી નથી.

Scope of work, execution of work, penal clauses and other conditions.

8. The exact type of work and quantity of work is still undecided but the typical indicative kind

of works are Wild Animal, Enclosure, Ghats, Van Kutir,Van chetana Kendra, Toilet at Nursery,

Maintenance of Division/Range Office , Small Check Dam, Small Causeway, Pathway, CC or RCC

roads, etc. The exact type, quantity of various items, place etc. will be decided by the Deputy

Conservator of Forests based on the technical inputs from the selected agency, site requirement, fund

availability etc. The deputy conservator of forest will have full right to drop or modify or add any

item in the indicative list even after finalisation of tender and will be binding on the agency.

હાલમા ં કામગીરીનુ ં ચોકકસ પર્કાર અને જથ્થો િનિ ત નથી પણ સામાન્ય રીતે વન્યજીવ,

એન્ક્લોઝર, ઘાટ, વનકુટીર, વન ચેતના કેન્દર્, નસર્રીમા ં ટોઇલેટ,ડીવીઝન/રેંજ ઓફીસ મરામત,

નાના ચેકડેમ, નાન ુકોઝવે, ર તાનુ ંકામ, સી.સી.રોડ, આર.સી.સી.રોડ, વી કામગીરી કરવાની હોય

છે. કામગીરીનો ચોકકસ પર્કાર, જથ્થો, જગ્યા િવગેરે એજન્સી પાસેથી તાિતર્ક અિભપર્ાય, થળની

જ રીયાત, ફંડની ઉપલબ્ધતા િવગેરેના આધારે નાયબ વન નાયબ સરંક્ષક ી ારા પાછળથી જાણ

કરવામા ંઆવશે. નાયબ વન સરંક્ષકને કોઈને કોઈ કારણ આપ્યા વગર ટેન્ડર આખરીકરણ પછી

પણ આ ટેન્ડર મા ં દશાર્વેલ િવિવધ કામો પૈકી કોઇ પણ કામ ને પડતુ ં મકૂવાનુ ં સપંણૂર્ અને

આબાિદત અિધકાર રહશેે.

9. The party quoting least percentage will be declared as L1 and will be selected provided it

fulfils all other conditions.

એજન્સી સૌથી ઓછી ટકાવારી મા ંકામ કરવા તૈયાર હોય અને ટેન્ડરની અન્ય શરતો પરીપણૂર્

કરે તેને L1 તરીકે જાહરે કરવામા ંઆવશે.


10. The agencies will have to specify at what percentage of SOR (Standard Operating Rates)

they are willing to carry out works. Ex if the agency is willing to work at 105% of the rates specified

in the SOR then he has to write just 105% in the column “The percentage of SOR at which I am / we

are willing to work “of the financial bid.

સબિંધત એજન્સીએ SOR ( ટાન્ડડર્ ઓપરેિટંગ દરો) ના કેટલા ટકાવારીના દર મજુબ તેઓ કામો

હાથ ધરવા માટે સમંત છે તે પ ટ દશાર્વવાનુ ંરહશેે. દાખલા તરીકે સબંિધત એજન્સી SOR મા ં

િનદ ટ કરેલ દરોના 105 % મજુબ કામ કરવા માટે તૈયાર હોય તો તેને નાણાકંીય િબડના “

ટકાવારી દર હુ ં/ અમે કામ કરવા માટે તૈયાર /ં છીએ " કોલમમા ં105 % દશાર્વવાનુ ંરહશેે.

11. The indicated percentage would be applicable to all the works to be carried out under this

contract.

આ ટેન્ડરમા ંનકકી થયેલ ટકાવારી બધા કામ માટે લાગ ુમાનવામા ંઆવશે.

12. The rates calculated as per indicated percentage quoted would be inclusive of all the taxes

like service tax, professional tax , income tax etc. If required as per rules the TDS would be deducted

from the payment.

દશાર્વેલ દરોમા સિવર્સ ટેક્સ, પર્ોફેશનલ ટેક્સ, આવક વેરો િવગેરે તમામ કરો સામેલ કરવાન ુરહશેે.

જ રી જણાશે તો ચકુવણ ુકરતી વખતે િનયમ મજુબ ટીડીએસ કપાત કરવામા ંઆવશે.

13. The agency will have to get the design prepared as per instruction of the deputy conservator

of forest within 3 days of issuance of work order or letter asking for the same. Based on the design

the agency will have to get the estimates prepared as per the prevalent SOR and obtain technical

sanction from an appropriate authority.

એજન્સી ારા િડઝાઇન વકર્ ઓડર્ર અથવા તે હતેનુા પતર્ મળવાના 3 િદવસની અંદર નાયબ વન

સરંક્ષકની સચૂના મજુબ તરીકે તૈયાર કરવાનુ ં રહશેે. િડઝાઇન પર્વતર્માન SOR મજુબ તૈયાર

કરવાનુ ંરહશેે અને યોગ્ય સ ા પાસેથી તાિંતર્ક મજૂંરી મેળવવાની રહશેે.

14. The agency must start the work within three days of issue of work order. If the agency fails to

execute the work within 30 days of execution of work order then a penalty at the rate of 1 % per day

of delay (subject to maximum of 10%) to be calculated on the total work order amount, may be

imposed. It may be waived off by the Deputy conservator of forests if the delay is not because of the

reasons attributable to the agency. The decision of the Deputy conservator of forests will be final in

this respect.


એજન્સી વકર્ ઓડર્ર મ યેથી તર્ણ િદવસની અંદર કામ શ કરવાનુ ંરહશેે. જો એજન્સી ૩૦ િદવસની

અંદર કામ કરવામા ંિન ફળ જશે તો વકર્ ઓડરની કુલ રકમના ૧% િદવસ પર્માણે (મહ મ ૧૦%ની

મયાર્દામા) તેમના પાસેથી દંડ વસલુ કરી શકાશે. જો નાયબ સરંક્ષક ીને એમ જણાશ ે કે એજનં્સી

પાસે આ િવલબં એજનં્સી ના કારણે નથી તો નાયબ વન સરંક્ષક ી આ દંડ માફ કરી શકે છે. આ

સદંભર્મા ંનાયબ સરંક્ષક િનણર્ય અંિતમ રહશેે.

15. If the agency fails to execute the work with the required quality or the delay is already more

than 10 days or is likely to be more than 10 days then the contract can be cancelled and any other

agency willing to work at that rate can be awarded the work. In such cases the agency will be paid

on the basis of the actual work done on the spot. The decision of the Deputy conservator of forests

will be final in this respect.

જો સબંિધત એજન્સી તેને સોપેલ કામગીરી ગણુવ ાસભર ના કરે અથવા િવલબં ૧૦ િદવસથી

વધારે થઇ ગયા હોય અથવા ૧૦ િદવસથી વધારે િવલબં થવાની શક્યતા હોયતો તેને તાત્કાિલક

અસરથી કામગીરી પરથી દુર કરીને િનયમનુસંાર તેનો કરાર રદ કરવામા ંઆવશે, અને ત્યાર પછી

જો અન્ય કોઇ એજન્સી આ દરથી કામગીરી કરવા સમં હશે તો તેને કામગીરી સોપવામા ંઆવશે.

આવા સજંોગોમા ંસબંિધત એજસંીને ચકુવણ ુ થળ ઉપર ખરેખર કરેલ કામગીરી મજુબ કરવામા ં

આવશે. અને આવા સજંોગોમા નાયબ વન સરંક્ષક ીનો િનણર્ય આખરી રહશેે.

16. Applications are liable to be summarily rejected due to incomplete, incorrect information or

non-fulfilment of eligibility criteria.

અપણૂર્, ખોટી માિહતી આપનાર અથવા યોગ્યતા માપદંડ ન ધરાવતા હોય તેવા બીડ ને

વીકારવામા ંઆવશે નિહ.

17. Tenders received late on account of any reason whatsoever will not be entertained.

કોઈ પણ કારણસર થી િવલિંબત ટેન્ડર ને વીકારવામા ંઆવશે નિહ

18. The rates quoted should include all kinds of cost like material, labour, transportation etc.

દશાર્વેલ દરમા ંતમામ પર્કારના ખચર્ વી સામગર્ી, મજૂરી, પિરવહન વગેરે સમાવેશ કરવાનો

રહશેે.


19. The agency will be asked to execute the work directly by the RFO. The agency will have to

execute the work within the specified time and produce the bill within 7 days of completion of work

clearly specifying the items sanctioned SOR , agreed percentage, quantity etc to the concerned RFO.

RFO may also instruct to get the signatures of concerned Forester or Guard if they have been allotted

the work of the supervision.

સબંિધત રેન્જના પરીકે્ષતર્ વન અિધકારી ારા સિુચબધ્ધ એજન્સીને કામગીરી માટે હકુમ આપવામા ં

આવશે. એજન્સીએ કામના નક્કી કરેલ ધારા-ધોરણ અને િનયત કરેલ સમયે કામગીરી પણુર્ કરી,

કામગીરી પણુર્ થયાના ૭ િદવસમા ંચકુવણી માટેના બીલ રજુ કરવાના રહશેે. મજુંર થયેલ SOR

એજન્સી ારા વીકૃત ટકાવારી દર, કામનો જથ્થો વગેરે િવગતો સાથેના બીલ હદના બીટગાડર્/

ફોરે ટરોની પર્િત સહી મેળવી પિરક્ષેતર્ વન અિધકારી ીની કચેરીમા ંરજુ કરવાના રહશેે.

20. The agency will have to get the technical sanction for the work from appropriate authority

before starting the work.

એજન્સીએ કામ શ કરતા પહલેા યોગ્ય સ ા પાસે થી કામ માટે તાિંતર્ક મજૂંરી મેળવવાની રહશેે.

21. The agency will have to maintain the measurement books etc which must be maintained

properly by the agency and also get the signatures of the concerned officers as per instructions.

એજન્સીએ આ કામગીરીની માપપોથી (Measurement book) વગેરે યોગ્ય રીતે િનભાવવાની રહશેે.

અને સચૂના પર્માણે સબંિંધત અિધકારી ીની સહીઓ પણ મેળવાની રહશેે.

22. Even after payment if any deficiency is found in quality or quantity in the works then also the

agency will be penalised and may even be blacklisted.

થયેલ કામગીરીની ચકુવણી થયા પછી પણ તેની ગણુવ ા અથવા જથ્થામા ં કોઈ ક્ષિત જોવા

મળશે તો, એજન્સીને દંડ કરવામા ંઆવશે અને જ ર જણાયતો તેને બ્લેક િલ ટ કરવામા ંઆવશે.

23. Deputy conservator of forests will have full rights to issue any clarification regarding the

interpretation of any of the terms or condition in the interest of better execution of work and the

same will binding on the agency.

કામગીરી વધ ુસારી રીતે થઇ શકે તે માટે શરતો અને િનયમોના અથર્ઘટન અંગેનો અબાિધત હક્ક

નાયબ સરંક્ષક ીનો રહશેે અને તે એજન્સીને તે બધંનકતાર્ રહશેે.


24. The agency will be solely responsible legally and financially to ensure compliance of any act

like minimum wages, ID act , insurance, transportation, medical, workman compensation, safety etc.

The agency will have to provide all the necessary medical and safety devices on the work spot.

અ ન્સી ારા કામગીરી પર રોકવામા ંઆવેલ મજુરોને લગત તમામ કાયદાકીય બાબતો, વી કે

મજુર િવમો, મજુર કાયદાનો અમલ, ઔધોગીક િવવાદધારો, ન્યનુતમ દૈિનક વેતનદર, સરુક્ષા

વગેરે કાયદાઓન ુ પાલન અને તેમાથંી ઉપિ થત થતી તમામ કાયદાકીય અને નાણાકીય

જવાબદારીનુ ંવહન કરવાનુ ં રહશેે. કામ પર આવતા મજુરોની સરુક્ષા સબંિંધત તમામ સાધન-

સામગર્ી એજન્સીએ પરૂી પાડવાની રહશેે. ના અભાવે કોઇ અક માત/દુધર્ટના બનશે તેની સમગર્

જવાબદારી સ પેલ એજન્સીને રહશેે અને તેઓને ન્યાિયક અને ફોજદારીની તમામ બાબતોની

જવાબદારી રહશેે. કામગીરીના થળે એજ્ન્સીએ તમામ પર્કારની મેડીકલ અને સરુક્ષા ઉપકરણોની

યવ થા કરવાની રહશેે.

25. The successful agencies will be required to furnish an affidavit duly notarised in the format

provided by the Deputy conservator of forests.

એજન્સીએ નાયબ વન સરંક્ષક ીની કચેરીમા ં િનયત કરેલ નમનુામા ંકરાર અંગેનુ ંએફીડેવીટ કરી

તેને નોટરી પાસેથી પર્માિણત કરાવી રજુ કરવાનુ ંરહશેે.

26. The Deputy conservator of forests will have full rights to suspend or even terminate this

tendering process at any stage without assigning any reason to anyone.

નાયબ વન સરંક્ષક ીને આ પર્િકર્યાને કોઈપણ તબકે્ક આ કામગીરી થિગત અથવા સમાપ્ત કરવા

માટે સપંણૂર્ અિધકાર રહશેે.

27. Duration of empanelment : Initial empanelment will be upto Date 31/3/2018 but can

be extended upto Date 31/3/2019 if both the parties ie the agency and the concerned division

are willing.

પર્થમ તબ્બક્કા મા ંસિુચબધ્ધ કરેલ પાટ ઓ તા.૩૧/૦૩/૨૦૧૮ સધુી અિધકૃત રહશેે. પરંત ુસબંિંધત

િવભાગ અને સિુચબધ્ધ પાટ બં ેની સમંતી હશે, તો તેને તા.૩૧/૦૩/૨૦૧૯ સધુી લબંાવી શકાશે.


28. If there is any question of interpretation between the English version or Gujarati version of

the provisions the English version would prevail

જો જોગવાઈનુ ંઅંગેર્જી આવિૃ અને ગજુરાતી આવિૃ વચ્ચે અથર્ઘટન નુ ંકોઈ પર્ ઉપિ થત
