NEW DELHI: The Supreme Courton Friday directed JaypeeSports International Ltd thatis organising the Formula OneIndian Grand Prix, to deposit25% of the ticket sale proceedsin a separate bank account.

The apex court direction fol-lowed a public interest litiga-tion questioning the legality of

the entertainment tax reliefgiven by the UP government.A bench of justice DK Jain

    and justice AR Dave restrained

Jaypee Sports from operatingthe account without the courtspermission till the final outcomeof the PIL.

Although Indias first F-1 event scheduled to begin in GreaterNoida in the national capitalregion on October 28 wouldnot be affected, the court saidthat it would examine whetherthe track was built according tothe development plan of the area.

    Rejecting the companys argu-

ment that the direction wouldcause adverse publicity, thebench said since the moneywould be deposited in a no-lien

account, how it can causeadverse publicity we do notunderstand.

The petitioners counsel,Sanjiv Sen, contended thatFormula One was an elitist eventand there was no justificationfor granting tax relief. Inresponse, government counselGopal Subramanium said thestadium and the event werepart of the states special devel-opment zone project.

At this, the bench said it wouldalso examine UP governmentspolicy of acquiring land for devel-oping the special economic zone.

NOIDA/ALLAHABAD: The AllahabadHigh Court on Friday gave thebest possible Diwali gift to onelakh families who had been wait-ing in despair after investing inhomes in the affordable resi-

dential hub in the eastern partof the national capital region(NCR).

The court ruled that ratherthan declaring the housing proj-ects being built in Greater Noida(GNoida) area as illegal, com-pensation for farmers whoseland had been acquired be hiked.

We are happy that the courthas thought of our interests, said GL Sagar, general secre-tary of Noida Extension FlatBuyers Welfare Association.

For the Mayawati govern-ment in Uttar Pradesh though, the quashing of a 2007 notifi-cation to acquire about 5,000hectares of land in three villagesin Greater Noida Asadullapur,Yusufpur Chak Shaber i andDevla came as a blow.

While there are no housingprojects in these villages, thecourt ordered that similarlyaffected farmers of other vil-lages where apartments arebeing built also be given high-

    er compensation.The Greater Noida Industrial

Development Authority(GNIDA), under whose juris-diction the affected area falls, said all projects in the areawould resume in a month.

The court has asked us to pay64% additional compensationand 10% developed land to farm-ers, close to the out-of-court set-tlement figures, GNIDA CEORama Raman told HT.

He also said since GNIDAworked on a no-profit-no-lossbasis, the extra money wouldbe claimed from builders, insti-tutions and industries.

The higher compensationwill result in an additional bur-den of R3,000 to R4,000 croreon the authority, Raman toldreporters. Builders earlier saidthe increase in costs would notbe passed on to existing cus-tomers.

For new customers though, experts said the ruling was like-ly to push prices up by 15% to20% in the area as builders wouldseek to cover the additional costof paying off farmers.

Not everyone is entirely happywith the judgment, though.

The court ruling is balanced, but not giving e ntire relief toany stakeholders the gov-ernment, farmers, builders andbuyers, said Pankaj Bajaj, pres-

ident of NCRs biggest realtorsbody. Farmers, too, said theywould move the Supreme Court, seeking more money.

    DREAMS RESTORED

What the Allahabad high court verdict means for homeowners, the government, builders and farmers

What this means for buyersPeople who have alreadybooked flats in the affected

projects (Page 4) are safe, sincethere will be no cost escalationfor them. New buyers will haveto pay 10-15% more for freshbookings.

WhyAdditional compensation willcost the Greater NoidaAuthority about R4,000 crore, which builders will have to pay.Since their contracts with exist-ing buyers have a no-escalationclause, they will charge newbuyers more

    What did the HC order?

The HC struck down theacquisition of land in three

villages Asadullapur,Yusufpur Chak Shaberi andDevla (where no housingprojects are planned).Farmers in 60 other vil-lages where land had beenacquired (with new proj-ects coming up) would beentitled to 64.7% highercompensation and also getdeveloped land equivalentto 10% of the acquiredland subject to a limit of2,500 sq m per farmer.

Some farmers, dissatisfied with the increasedcompensation, plan to move Supreme Court toincrease the amount. Authorities and builderswork out modalities for paying the increasedcompensation shortly. Existing buyers arerelieved, new ones will have to pay more

NEW DELHI:A US-basedNRI doctor has beenawarded a record com-pensation of overR1.77crore by the nationalconsumer court for thedeath of his wife in 1998due to medical negli-gence in a private hos-pital in Kolkata.

The National Consu-mer Dispute RedressalCommission (NCDRC)ordered Kolkata-basedAdvanced Medicar eand Research Institute

(AMRI) and its three doctors Sukumar Mukherjee,Baidyanath Haldar and BalramPrasad to share the amountto be paid to Dr Kunal Saha.

An NCDRC bench fixed thecompensation on the directionof the Supreme Court, which hadreferred Sahas appeal to it. Thecourt held the doctors and thehospital culpable to civil liabili-ty for medical negligence, whichled to the death of Anuradha, 36,a child psychologist. Anuradha

was hospitalised after she com-plained of rashes.Saha had sought over R77

    crore on account of mental

agony, loss of income, cost oftreatment, travel and hotelexpenses, breakdown of fami-ly and cost of litigation. But, thecourt awarded a compensationofR1,77,87,500 (includingR5 lakhtowards cost of litigation) only.

A complainant cannot beallowed to get undue enrich-ment by making a fortune outof a misfortune, said the judge.

Blaming Saha for interfer-ing in Anuradhas treatment, the court even ordered a 10%deduction in compensation.

Although it is by far the high-est compensation in Indianmedico-legal history, this is atravesty of justice as it is toomeagre an amount, said Saha.

In Kolkata, AMRI executivedirector BN Agarwal said, Aftergoing through the order, if we

find the amount unreasonable,or unjustified, we will move theSupreme Court again.

WASHINGTON: President BarackObama said on Friday the UnitedStates would fulfill its pledge topull troops out of Iraq by the endof the year. After nearly nineyears, Americas war in Iraq willbe over, Obama told reporters.

He spoke after a video con-

ference with Iraqi prime minis-ter Nuri al-Maliki and said thetwo were in full agreement abouthow to move forward on troopwithdrawal as promised whenhe took over.

Obama said the two countriesnow moved into a new phaseand that it would be an equalpartnership based on mutualinterests and mutual respect.

The withdrawal of Americantroops marks a major milestonein the war that started in 2003and resulted in the removal ofSaddam Hussein from power inIraq.

Over the next two months, our troops in Iraq, tens of thou-sands of them, will pack up theirgear and board convoys for thejourney home, Obama said.

The last American soldierwill cross the border out of Iraqwith their heads held high, proudof their success, and knowingthat the American people standunited in our support for our

troops, he said. That is how Americas mili-

tary efforts in Iraq will end.The US military role in Iraq

has been mostly reduced to advis-ing the security forces in a coun-try where levels of violence haddeclined sharply from a peak ofsectarian strife in 2006-2007, butattacks remain a dailyoccurrence.

Senior Iraqis say in privatethey still like a US troop pres-ence to keep the peace betweenIraqi Arabs and Kurds in a dis-pute over who controls the oil-rich areas in the north of Iraq.
