BRIEF PROFILE OF MR. SHANKAR KR. JHA, ADVOCATE

Mr. Shankar Kumar Jha, is a graduate in Chemistry (Hons.) and a graduate in Law from Campus Law Centre, University of Delhi. He has been in active legal practice and consultancy since 1995.

His main areas of practice are litigations, arbitrations, property laws, constitutional laws, corporate laws, labour and industrial laws, banking laws, consumer laws, intellectual property rights, criminal complaints and trials, etc.

In litigation and arbitration, he has extensive experience in representing causes of various clients in matters relating to commercial disputes, tenders, debt recoveries, trade marks, copyrights and patent disputes, trade agreements, banking, land acquisition, land user norms, environment issue, labour and employment, consumer protection, restrictive and unfair trade practices, industrial regulation issues, hire-purchase, finance, international trade, etc.

He has extensive litigation and transactional experience having practiced in the Supreme Court of India, Delhi High Court and various other High Courts of States in India and Trial Courts and has opportunities to hire services and to assist various Senior Advocates. He has successfully represented the cause of his clients in the areas of commercial disputes; inter corporate disputes, intellectual property, land laws, urban development laws, labour and employment laws, criminal trials, from the trial stage through all levels of proceedings. He has also worked for many Indian corporations in various Courts, Tribunals and Commissions in matters pertaining to employment laws, banking laws, industrial laws, intellectual properties, product liabilities, petroleum-laws, banking transactions, etc.

He also practices in National, State and District Consumer Commission/Forum, Debt Recovery Tribunals, Debt Recovery Appellate Tribunals, BIFR, AIAFR, MACT, among other Courts and Tribunals. He has also conducted out of court disputes resolution process as sole arbitrator in various matters.

He has also diversified experience of pre-litigation and post-litigation settlement processes and transactional negotiations relating to strategic alliances, collaborations, joints ventures, insurance claims, formation and dissolution of partnership, property disputes, recovery disputes, etc.

He has also wide experience in advising on infrastructure development in the light of governmental regulations relating to zoning, land use, building bye-laws, master plans, construction norms, urban land & development laws, investigation and search of titles, verification of claim regarding proprietary rights, projects’ development, leasing, structuring real estate transactions, conveyancing etc. He has extensive experience in drafting and execution of Production Sharing Contracts, Joint Operating Agreements, Joint Production Agreements, Joint Bidding Agreements, Share Purchase Agreements, Confidentiality Agreements, and various other deeds and documents. He has been providing consultancy services on transactions modalities, legal structuring, vetting of contract documents, agreements for appointment of Agents/representatives in India, Franchisee, DSA, documentations for international cross border transactions, acquisitions and mergers, legal due diligence, joint ventures, shareholders issue, company formation and maintenance, establishment of representative offices in India, branches and subsidiaries, technology transfers, know-how licensing, assignments, corporate tax planning etc.
