काआ 2631(अ)-- िन िलिखत ा प अिधसचना िजस क ीय सरकार पयावरण (सर ण) अिधिनयम 1986 (1986 का 29) क धारा 3 क उपधारा (2) क खड (v) और खड (xiv) तथा उपधारा (3) क साथ प ठत उपधारा (1) ारा द शि य का योग करत ए जारी करन का ताव करती ह पयावरण (सर ण) िनयम 1986 क िनयम 5 क उपिनयम (3) क अप ानसार जनसाधारण क जानकारी क िलए कािशत क जाती ह िजनक उसस भािवत होन क सभावना ह और यह सचना दी जाती ह क उ ा प अिधसचना पर उस तारीख स िजसको इस अिधसचना वाल भारत क राजप क ितया जनसाधारण को उपल ध करा दी जाती ह साठ दन क अविध क समाि पर या उसक प ात िवचार कया जाएगा

िबिलिग ररगा वामी म दर व यजीव अभयार य कनाटक रा य सरकार क अिधसचना स एफईई 1333 एफड यएल-2008 तारीख 2412011 ारा 57482 वग कलोमीटर क को ा आरि ती क प म घोिषत कया था

क प म भी काय करता ह

और ा आरि ती सोिलगा व य िनवासी समदाय क गह आवास क प म भी ह जो अभयार य म छोट परव म िनवास करत ह

और िबिलिग ररगा वामी ा आरि ती क चार ओर क को िजसका िव तार और सीमाए इस अिधसचना क परा 1 म िविन द ह पयावरण क दि स पा रि थितक सवदी जोन क प म सरि त और सरि त करना तथा उ पा रि थितक सवदी जोन म उ ोग या उ ोग क वग क चालन तथा स करण करन को ितिष करना आव यक ह

अतः अब क ीय सरकार पयावरण (सर ण) िनयम 1986 क िनयम 5 क उपिनयम (3) और पयावरण (सर ण) अिधिनयम 1986 (1986 का 29) क धारा 3 क उपधारा (2) क खड (v) और खड (xiv) क साथ प ठत और उपधारा (1) ारा द शि य का योग करत ए कनाटक रा य म िबिलिग ररगा वामी ा आरि ती क सीमा स 6 कलोमीटर तक िव ता रत को िबिलिग ररगा वामी ा आरि ती पा रि थितक सवदी जोन (िजस इसम इसक प चात पा रि थितक सवदी जोन कहा गया ह) क प म अिधसिचत करती ह िजसका िववरण िन ानसार ह अथात--

1 पा रि थितक सवदी जोन का िव तार और उसक सीमाए--(1) पा रि थितक सवदी जोन तिमलनाड क साथ अतरा यीय सीमा क भाग क िसवाय िबिलिग ररगा वामी ा आरि ती पा रि थितक सवदी जोन क

सीमा स 6 कलोमीटर तक वतनीय क सीमा का वणन उपाबध-I म दया गया ह

(2) पा रि थितक सवदी जोन क अतगत 49 ाम ह और यह 46792 वग कलोमीटर तक फला आ ह

(3) पा रि थितक सवदी जोन क सीमा का मानिच इस अिधसचना स उपाब उसक िव तार और दर थ िब द पर अ ाश और दशातर क साथ उपाबध II क प म दया गया ह

(4) पा रि थितक सवदी जोन क भीतर आन वाल ाम क सची और अ य उपाबध-III क प म दए गए ह

2 पा रि थितक सवदी जोन क िलए आचिलक महायोजना ndash (1) रा य सरकार पा रि थितक सवदी जोन क िलए राजप म अितम अिधसचना क काशन क तारीख स दो वष क अविध क भीतर थानीय ि य क परामश स और इस अिधसचना म सल न अनबध क सामज य स आचिलक महायोजना तयार करगी

(2) आचिलक महायोजना रा य सरकार म स म ािधकारी ारा अनमो दत होगी

(3) ा सर ण योजना भी आचिलक महायोजना म तयारी क दौरान यान म रखा जाएगा

(4) रा य सरकार ारा पा रि थितक सवदी जोन क िलए आचिलक महायोजना इस तरह इस अिधसचना म िविन द ट प तथा ससगत क ीय और रा य िविधय क सामज य और क ीय सरकार ारा जारी मागिनदश य द कोई ह ारा तयार होगी

(5) आचिलक महायोजना पयावरणीय और पा रि थितक िवचार को समाकिलत करन क िलए रा य सरकार क सभी सब िवभाग क परामश स तयार होगी अथात--

(i) पयावरण (ii) वन (iii) शहरी िवकास (iv) पयटन (v) नगरपािलका (vi) राज व (vii) किष (viii) कनाटक रा य दषण िनय ण बोड (ix) सचाई और (x) लो क िन माण िव भाग

(6) आचिलक महायोजना अनमो दत िव मान भ-उपयोग अवसरचना और याकलाप पर कोई िनबधन अिधरोिपत नह करगी जब तक क इस अिधसचना म िविन द ट न हो और आचिलक महायोजना सभी अवसरचना और याकलाप म अिधक द ता और पा रि थितक अनकलता का सवधन करगी

(7) आचिलक महायोजना म अना छा दत क जीण ार िव मान जल िनकाय क सर ण आवाह क बधन जल-सभर क बधन भतल जल क बधन मदा और नमी सर ण थानीय समदाय क आव यकता तथा पा रि थितक और पयावरण स सबिधत ऐस अ य पहल िजन पर यान दना आव यक ह क िलए उपबध ह ग

(8) आचिलक महायोजना सभी िव मान पजा थल ाम और नगरीय बदोब त वन क कार और क म किष ऊपजाऊ भिम ह रत जस उ ान और उसी कार क थान उ ान किष फलो ान

झील और अ य जल िनकाय का अ यकन करगी

4 THE GAZETTE OF INDIA EXTRAORDINARY [PART IImdashSEC 3(ii)] (9) आचिलक महायोजना थानीय समदाय क जीवकोपाजन को सिनि चत करन क िलए पा रि थितक सवदी जोन म िवकास को पा रि थितक अनकल िवकास क िलए िविनयिमत करगी

3 रा य सरकार ारा कए जान वाल उपाय-- रा य सरकार इस अिधसचना क उपबध को भावी करन क िलए िन िलिखत उपाय करगी अथात --

(1) भ-उपयोग - पा रि थितक सवदी जोन म वन उ ान-किष किष आमोद- मोद क योजन क िलए िचि हत कए गए पाक और खल थान का वािणि यक और औ ोिगक सब िवकास याकलाप क िलए उपयोग या सप रवतन नह होगा

परत पा रि थितक सवदी जोन क भीतर किष भिम का सप रवतन मानीटरी सिमित क िसफा रश पर और रा य सरकार क पव अनमोदन स थानीय िनवािसय क आवासीय ज रत को परा करन क िलए और परा 4 क सारणी क तभ (2) म म स0 12 17 23 32 और 35 क अधीन याकलाप को परा करन क िलए अन ात होगा अथात -

(i) पा रि थितक अनकल पयटन याकलाप क िलए पयटक क अ थायी आवासन क िलए पा रि थितक अनकल आरामगाह जस टट लकड़ी क मकान आ द (ii) िव मान सड़क को चौड़ा करना और सदढ़ करना (iii) दषण उ प न करन वाल लघ उ ोग (iv) वषा जल सचय और (v) कटीर उ ोग िजसक अतगत ामीण उ ोग सिव धाजनक भडार और थानीय सिव धाए भी ह

परत यह और क रा य सरकार क पव अनमोदन और सिव धान क अन छद 244 तथा त समय व िविध क उपबध क अनपालन क िबना िजसक अतगत अनसिचत जनजाित और अ य परपरागत वन िनवासी (वन अिधकार क मा यता) अिधिनयम 2006 (2007 का 2) भी ह वािणि यक या उ ोग िवकास याकलाप क िलए जनजातीय भिम का उपयोग अन ात नह होगा

परत यह और भी क पा रि थितक सवदी जोन क भीतर भ-अिभलख म उपसजात कोई ट इसम परा 3 म िन द ट मानीटरी सिमित क िवचार ा करन क प ात रा य सरकार ारा यक मामल म एक बार सशोिधत होगी और उ ट क सशोधन क क ीय सरकार क पयावरण वन और जलवाय प रवतन म ालय को सचना दनी होगी

परत यह और भी क उपय ट का सशोधन म इस उप परा क अधीन यथा उपबिधत क िसवाय कसी भी दशा म भ-उपयोग का प रवतन सि मिलत नह होगा

परत यह और भी क िजसस ह रत म जस वन किष आ द म कोई पा रणािमक कटौती नह होगी और अन य त या अन पादक किष म पन वनीकरण करन क यास कए जाएग

(2) ाकितक जल ोत-आचिलक महायोजना म सभी ाकितक जल ोत क पहचान क जाएगी और उनक सर ण और पन भतकरण क िलए योजना सि मिलत होगी और रा य सरकार ारा ऐस पर या उनक िनकट िवकास याकलाप ितिष करन क िलए ऐसी रीित स मागिनदश तयार कए जाएग

(3) पयटनndash(क) पा रि थितक सवदी जोन क भीतर पयटन सबधी याकलाप पयटक महायोजना क अनसार ह ग जो आचिलक महायोजना का एक भाग बनग


(ख) पयटन महायोजना पयटन िवभाग ारा रा य सरकार क वन और पयावरण िवभाग क परामश स तयार क जाएगी

(ग) पयटन सबधी याकलाप िन निलिखत क अधीन िविनयिमत ह ग अथात -

(i) पा रि थितक सवदी जोन क भीतर सभी नए पयटन याकलाप या िव मान पयटन याकलाप का िव तार क ीय सरकार क पयावरण वन और जलवाय प रवतन म ालय क मागदशक िस ात क ारा तथा पा रि थितक पयटन रा ीय या सर ण ािधकरण ारा जारी (समय-समय पर यथा सशोिधत) मागदशक िस ात क अनसार पा रि थितक पयटन पा रि थितक िश ा और पा रि थितक िवकास को मह व दत ए पा रि थितक सवदी जोन क वहन मता क अ ययन पर आधा रत होगा

(ii) पा रि थितक अनकल पयटन याकलाप स सबिधत पयटक क अ थायी अिधभोग क िलए वास सिवधा क िसवाय सरि त क सीमा स एक कलोमीटर तक या पा रि थितक सवदी जोन क सीमा तक इनम जो भी िनकट ह नय वािणि यक होटल और रसोट अन ात नह ह ग परत जहा पा रि थितक सवदी जोन का िव तार एक कलोमीटर स यादा ह वहा एक कलोमीटर स पर और पा रि थितक सवदी जोन क सीमा तक सभी नए पयटक याकलाप या िव मान याकलाप का िव तार पयटन महायोजना और रा ीय या सर ण ािधकरण क अनसार होगा

(iii) आचिलक महायोजना का अनमोदन कए जान तक पयटन क िलए िवकास और िव मान पयटन याकलाप क िव तार को वा तिवक थल िविन द सवी ा तथा मानीटरी सिमित क िसफा रश पर

आधा रत सबिधत िविनयामक ािधका रय ारा अन ात कया होगा

(4) नस गक िवरासत - पा रि थितक सवदी जोन म मह वपण नस गक िवरासत क सभी थल जस सभी जीन कोश आरि त शल िवरचनाए जल पात झरन घाटी माग उपवन गफाए थल मण अ रोहण पातो आ द क पहचान क जाएगी और उ ह सरि त कया जाएगा तथा उनक सर ा और सर ा क िलए इस अिधसचना क काशन क तारीख स छह मास क भीतर उपय योजना बनाएगी और ऐसी योजना आचिलक महायोजना का भाग होगा

(5) मानव िन मत िवरासत थल - पा रि थितक सवदी जोन म भवन सरचना िश प-त य ऐितहािसक कला मक और सा कितक मह व क क पहचान करनी होगी और इस अिधसचना क काशन क तारीख स छह माह क भीतर उनक सर ण क योजनाए तयार करनी होगी तथा आचिलक महायोजना म सि मिलत क जाएगी

(6) विन दषण - पा रि थितक सवदी जोन म विन दषण क िनय ण क िलए रा य सरकार का पयावरण िवभाग वाय ( दषण िनवारण और िनय ण) अिधिनयम 1981 (1981 का 14) और उसक अधीन बनाए गए िनयम क उपबध क अनसरण म मागदशक िस ात और िविनयम तयार करगा

(7) वाय दषण - पा रि थितक सवदी जोन म वाय दषण क िनय ण क िलए रा य सरकार का पयावरण िवभाग वाय ( दषण िनवारण और िनय ण) अिधिनयम 1981 (1981 का 14) और उसक अधीन बनाए गए िनयम क उपबध क अनसरण म मागदशक िस ात और िविनयम तयार करगा

(8) बिह ाव का िन सारण ndash पा रि थितक सवदी जोन म उपचा रत बिह ाव का िन सारण जल ( दषण िनवारण तथा िनय ण) अिधिनयम 1974 (1974 का 6) और उसक अधीन बनाए गए िनयम क उपबध क अनसार होगा

(9) ठोस अपिश ndash ठोस अपिश का िनपटान िन िलिखत प म होगा -


(i) पा रि थितक सवदी जोन म ठोस अपिश का िनपटान भारत सरकार क त कालीन पयावरण वन और जलवाय प रवतन म ालय क समय-समय पर यथा सशोिधत अिधसचना स काआ 1357(आ) तारीख 8 अ ल 2016 नगरपािलक ठोस अपिश बध िनयम 2016 क उपबध क अनसार कया जाएगा

(ii) थानीय ािधकरण जव िन ीकरणीय और अजव िन ीकरणीय सघटक म ठोस अपिश क सपथ न क िलए योजनाए तयार करग

(iii) जव िन ीकरणीय साम ी को अिधमानतः खाद बनाकर या किम खती क मा यम स पनःच त कया जाएगा

(iv) अकाबिनक साम ी का िनपटान पा रि थितक सवदी जोन क बाहर पहचान कए गए थल पर कसी पयावरणीय वीकत रीित म होगा और पा रि थितक सवदी जोन म ठोस अपिश ट को

जलाना या भ मीकरण अन ात नह होगा

(10) जव िच क सीय अपिश ट- पा रि थितक सवदी जोन म जव िच क सीय अपिश का िनपटान भारत सरकार क पयावरण वन और जलवाय प रवतन म ालय क समय-समय पर यथासशोिधत अिधसचना िजएस आर 343 (अ) तारीख 28 माच 2016 ारा कािशत जव िच क सीय अपिश बध िनयम 2016 क उपबध क अनसार कया जाएगा

(11) यानीय प रवहन -प रवहन क यानीय गितिविधया आवास क अनकल िविनयिमत ह गी और इस सबध म आचिलक महायोजना म िवशष उपबध अिधकिथत कए जाएग और आचिलक महायोजना क तयार होन और पयावरण वन और जलवाय प रवतन म ालय क अनमो दत होन तक पा रि थितक सवदी जोन मानीटरी सिमित

व िनयम और िविनयम क अनसार यानीय गितिविधय क अनपालन को मानीटर करगी

(12) औ ोिगक इकाईया - (क) तािव त पा रि थितक सवदी जोन म नए का ठ आधा र त उ ोग क थापना क िस वाए िव िध क अनसार थािप त िव मान का ठ आधा र त उ ोग को अन ात नह क या जाएगा

(ख) जल वाय मदा विन दषण का र त करन वाल क सी नए उ ोग क तािव त पा रि थितक सवदी जोन म थापना को अन ात नह क या जाएगा

4 पा रि थितक सवदी जोन म ितिष और िविनयिमत याकलाप क सची - पा रि थितक सवदी जोन म सभी याकलाप पयावरण (सर ण) अिधिनयम 1986 क उपबध ारा शािसत ह ग और नीच दी गई तािलका म िविन द रीित म िविनयिमत ह ग अथात --

(ख) खनन स याए माननीय उ तम यायालय क रट यािचका (िसिवल) स 1995 का 202 टीएन गौडाबमन िथ मलपाद बनाम भारत सघ क मामल म आदश तारीख 4 अग त 2006 और रट यािचका (सी) स 2012 का 435 गोवा फाउडशन बनाम भारत सघ क मामल म तारीख 21 अ ल 2014 क अत रम आदश क अनसरण म सवदा चालन होगा

(2) आरा मील क थापना पा रि थितक सवदी जोन क भीतर नई और िव मान आरा मील का िव तार अन ात नह होगा

(3) जल या वाय या मदा या विन दषण का रत करन वाल उ ोग क थापना

पा रि थितक सवदी जोन क भीतर नए और िव मान दषण का रत करन वाल का िव तार अन ात नह होगा

(4) जलावन लकड़ी का वािणि यक उपयोग लाग िविधय क अनसार ितिष (अ यथा उपबिधत क िसवाय)

(5) नई बहत जल िव त प रयोजना और सचाई प रयोजना क थापना

लाग िविधय क अनसार ितिष (अ यथा उपबिधत क िसवाय)

(6) क ही प रसकटमय पदाथ का उपयोग या उ पादन


(7) ाकितक जल िनकाय या सतही म अनपचा रत बिह ाव और ठोस अपिश का िन सारण


(8) नए का आधा रत उ ोग लाग िविधय क अनसार ितिष (अ यथा उपबिधत क िसवाय)

(9) वािणि यक उपयोग क िलए ाकितक जल ससाधन िजसक अतगत वािणि यक खिनज जल सय वाितत पय बोतल भराव सय आ द क िलए भिमगत जल को एक करना

पा रि थितक अनकल पयटन याकलाप स सबिधत पयटक क अ थायी अिधभोग क िलए वास सिवधा क िसवाय सरि त क सीमा स एक कलोमीटर तक या पा रि थितक सवदी जोन क सीमा तक इनम जो भी िनकट ह नय वािणि यक होटल और रसोट अन ात नह ह ग


परत जहा पा रि थितक सवदी जोन क सीमा एक कलोमीटर स यादा ह वहा एक कलोमीटर स पर और पा रि थितक सवदी जोन

क सीमा तक सभी नए पयटक याकलाप या िव मान याकलाप का िव तार पयटन महायोजना और रा ीय या सर ण ािधकरण क अनसार होगा

(13) सिनमाण याकलाप (क) सरि त क सीमा स एक कलोमीटर तक या पा रि थितक सवदी जोन क सीमा तक इनम जो भी िनकट ह क भीतर कसी भी

कार का नया वािणि यक सिनमाण अन ात नह होगा परत थानीय यि तय को अपन आवासीय उपयोग िजसक अतगत परा 3 क उपपरा (1) म सचीब याकलाप भी ह क िलए अपनी भिम पर सिनमाण करन क अनमित होगी (ख) दषण उ प न न करन वाल लघ उ ोग स सबिधत सिनमाण

याकलाप िनयम या िविनयम य द कोई लाग ह क अनसार स म ािधकारी स पव अनमित ा त करन क प चात अन ात ह ग

(ग) पर त जहा पा रि थितक सवदी जोन क सीमा एक कलोमीटर स यादा ह तो वहा एक कलोमीटर क प चात और पा रि थितक सवदी

जोन क सीमा तक थानीय यि तय क स ावी आव यकता क िलए सिनमाण अन ात होगा तथा अ य वािणि यक सिनमाण याकलाप आचिलक महायोजना क अन प ह ग

(14) व क कटाई (क) रा य सरकार म स म ािधकारी क पव अनमित क िबना वन सरकारी या राज व या िनजी भिम पर या वन म कही व क कटाई नह होगी

(ख) व क कटाई सबिधत क ीय या रा य अिधिनयम या उसक अधीन बनाए गए िनयम क उपबध क अनसार िविनयिमत होगी

(3) इस अिधसचना क परा 4 क अधीन यथा िविन द ितिष याकलाप क िसवाय भारत सरकार क पयावरण और वन म ालय क अिधसचना स याक काआ 1533(अ) तारीख 14 िसतबर 2006 क अिधसचना क अनसची क अधीन ऐस याकलाप िज ह सि मिलत नह कया गया ह परत पा रि थितक सवदी जोन म आत ह ऐस याकलाप क वा तिवक िविन द थलीय दशा पर आधा रत मानीटरी सिमित ारा सवी ा क जाएगी और उस सब िविनयामक ािधकरण को िन द कया जाएगा

SO 2631(E)mdashThe following draft of the notification which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) is hereby published as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules 1986 for the information of the public likely to be affected thereby and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public

Draft Notification

WHEREAS The Biligirirangaswamy Temple Wildlife Sanctuary was declared as a Tiger Reserve with an extent of 57482 square kilometer vide notification of the State Government of Karnataka No FEE 1333 FWL 2008 dated 2412011

AND WHEREAS the Biligirirangaswamy Temple Tiger Reserve is situated in Chamrajanagar District (Kollegal Yelandur and Chamrajanagar talukas) of Karnataka State and lies between the North Latitudes11deg43 and12deg 08 and between the East Longitudes 77deg 00 and 77deg16

AND WHEREAS the Tiger Reserve harbours Tiger Elephant Guar leopard sambar spotted deer barking deer four horned antelope sloth bear wild dogs mouse deer etc

AND WHEREAS the Tiger Reserve is a part of the Nilgiri Biosphere Reserve and the Mysore Elephant Reserve declared by Project Elephant Government of India

AND WHEREAS the entire protected area along with adjoining areas of Sathyamangala Division Madumalai Protected Area Kollegal Division Cauvery Wildlife Division forms a unique patch of forests which acts as a bridge between Western Ghats and Eastern Ghats

AND WHEREAS the Tiger Reserve has a variety of vegetation ranging from dry scrub jungle to evergreen forests and shrub savannas and high altitude grasslands

AND WHEREAS 28 species of Mammals 274 species of birds 14 species of amphibions 23 species of reptiles 1350 species of flora 145 species of butterflies more than 886 species of medicinal plants and around 25 species of orchids are reported from the Tiger Reserve

AND WHEREAS the vegetation comprises of Anogeissus latifolia Dalbergia paniculata Baswellia serrata Commiphora caudate Acacia chundra Diospyros melanoxylon Elaeocarpus tuberculatus syzygium malabaricum Schefflera capitata Cucurma neilgherrensis etc


AND WHEREAS the Protected Area is an important catchment area for Gundal and Suvarnavathi rivers that are major tributaries of River Cauvery and it also acts as an important catchment area for Gowdahalli Krishnaianakatte KK dam and Bellattha reservoirs

AND WHEREAS the Tiger Reserve is also home to Soliga forest dwelling communities who live in small hamlets within the sanctuary

AND WHEREAS it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the Biligiriranganswamy Tiger Reserve as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industry and their operations and processes in the said Eco-sensitive Zone

NOW THEREFORE in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of subndashsection (2) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules 1986 the Central Government hereby notifies an area to an extent of up to 6 kilometers from the boundary of Biligiriranganswamy Tiger Reserve in the State of Karnataka as the Biligiriranganswamy Tiger Reserve Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under namely-

1 Extent and Boundary of Eco-sensitive Zone-(1) The Eco-sensitive Zone has an extent varying up to 6 kilometers from the boundary of Biligiriranganaswamy Tiger Reserve except for the portion having interstate boundary with Tamil Nadu and the description of boundaries is given in Annexure I

(2) The Eco-sensitive Zone includes 49 villages and is spread over an area of 46792 square kilometers

(3) The map of Eco-sensitive Zone boundary together with latitudes longitudes is appended as Annexure II

(2) The list of villages and other areas falling within the Eco-sensitive Zone is given at Annexure-III

2 Zonal Master Plan for the Eco-sensitive Zone-(1) The State Government shall for the purpose of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of final notification in the Official Gazette in consultation with local people and adhering to the stipulations given in this notification

(2) The said Plan shall be approved by the Competent Authority in the State Government (3) The Tiger Conservation Plan shall also be taken into consideration during the preparation at the Zonal Master Plan (4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government if any (5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments namely- (i) Environment (ii) Forest (iii) Urban Development (iv) Tourism (v) Municipal (vi) Revenue (vii) Agriculture (ix) State Pollution Control Board (x) Irrigation (xi) Public Works Department for integrating environmental and ecological considerations into it (6) The Master Plan shall not impose any restriction on the approved existing land use infrastructure and activities unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly (7) The Zonal Master plan shall provide for restoration of denuded areas conservation of existing water bodies management of catchment areas watershed management groundwater management soil and moisture conservation needs of local community and such other aspects of the ecology and environment that need attention (8) The Zonal Master Plan shall demarcate all the existing worshipping places village and urban settlements types and kinds of forests agricultural areas fertile lands green area such as parks and like places horticultural areas orchards lakes and other water bodies

(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities

3 Measures to be taken by State Government-The State Governments shall take the following measures for giving effect to the provisions of this notification namely-

24 THE GAZETTE OF INDIA EXTRAORDINARY [PART IImdashSEC 3(ii)] (1) Land use- Forests horticulture areas agricultural areas parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee and with the prior approval of the State Government to meet the residential needs of local residents and for the activities listed against serial numbers 12 17 23 32 and 35 in column (2) of the Table in paragraph 4 namely- (i) Eco-friendly cottages for temporary occupation of tourists such as tents wooden houses etc for Eco-friendly tourism activities (ii) Widening and strengthening of existing roads (iii) Small scale industries not causing pollution (iv) Rainwater harvesting and (v) Cottage industries including village industries convenience stores and local amenities

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act 2006 (2 of 2007)

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government after obtaining the views of Monitoring Committee once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment Forests and Climate Change

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph

Provided also that there shall be no consequential reduction in green area such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas

(2) Natural Springs-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government to prohibit development activities at or near these areas in such a manner as which are detrimental to such areas

(3) Tourism- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan which shall form part of the Zonal Master Plan

(b) The Tourism Master Plan shall be prepared by Department of Tourism in consultation with Department of Forests and Environment Government of Karnataka

(c) The activity of tourism shall be regulated as under namely-

(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment Forests and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone

(ii) No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or the extent of Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities However where Eco-sensitive Zone extends beyond one kilometre

then beyond one kilometre and up to the extent of the Eco-sensitive Zone all new tourism activities or expansions of

existing activities would be conformity with Tourism Master Plan and National Tiger Conservation Authority guidelines

(iii) till the Zonal Master Plan is approved development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee

(4) Natural Heritage- All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas rock formations waterfalls springs gorges groves caves points walks rides cliffs etc shall be identified and preserved and plan shall be drawn up for their protection and conservation within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan

(5) Man-made heritage sites- Buildings structures artefacts areas and precincts of historical architectural aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan

(7) Air pollution- The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act 1981 (14 of 1981) and the rules made thereunder

(8) Discharge of effluents- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act 1974(6 of 1974) and the rules made thereunder

(9) Solid wastes - Disposal of solid wastes shall be as under-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number SO 908 (E) dated the 25th September 2000 as amended from time to time

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture

(iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone

(10) Bio-medical waste- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide Notification number SO 630(E) dated the 20th July 1998 as amended from time to time

(11) Vehicular traffic - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government the Monitoring Committee shall monitor compliance of vehicular movement the rules and regulations under the relevant Acts and made thereunder

(12) Industrial Units

(a) No establishment of new wood based Industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based Industries set up as per the Law

(b) No establishment of any new Industry causing water air soil noise pollution within the proposed Eco-sensitive zone shall be permitted

4 List of activities prohibited or to be regulated within the Eco-sensitive Zone- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act 1986 (29 of 1986) and the rules made thereunder and be regulated in the manner specified in the Table below namely-

2 Setting up of saw mills No new or expansion of existing saw mills shall be permitted within the Eco-sensitive zone

3 Setting up of industries causing water or air or soil or noise pollution

No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted

4 Commercial use of firewood Prohibited (except as otherwise provided) as per applicable laws

5 Establishment of new major hydroelectric projects

6 Use or production of any hazardous substances

No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or the extent of Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities

However where Eco-sensitive Zone extends beyond one kilometre then beyond one kilometre and up to the extent of the Eco-sensitive Zone all new tourism activities or expansions of existing activities would be conformity with Tourism Master Plan and National Tiger Conservation Authority guidelines

13 Construction activities (a) No new commercial construction of any kind shall be permitted within one kilometre of the boundary of the Protected Area or the extent of Eco-sensitive Zone whichever is nearer

Provided that local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub paragraph (1) of paragraph 3

(b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum with the prior permission from the Competent Authority as per applicable rules and regulations if any (c) construction activity in the ESZ shall be as per Zonal Master Plan


(d) However where Eco-sensitive Zone extends beyond one kilometer then beyond one kilometre and upto the extent of Eco- sensitive Zone construction for bona fide local needs shall be permitted and other commercial construction activities shall be in conformity with the Zonal Master Plan

14 Felling of trees (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government

(b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder

15 Erection of electrical cables and telecommunication towers

(a) Promote underground cabling

(b) Existing domestic lines ndash If over ground should be at the height of 20 feet for slope lt 20 degree and for slope gt 30 degree it should be at the height of 30 feet from the ground

(c) For any future laying of electric lines for the domestic purpose up to 11 KV has to be done underground

(d)For any transmission line more than 11 KV the ldquosagrdquo point between the two towers should be at least 15 meters from the ground

16 Electric fencing compound for commercial hotels resorts and commercial agricultural and horticultural ventures by companies corporate housesfirms

The fencing should be such that it does not affect the migration and movement of wildlife

17 Widening and strengthening of existing roads

shall be done with proper Environment Impact Assessment and mitigation measures as applicable

5 Monitoring Committee- (1) The Central Government hereby constitutes a Monitoring Committee for a period of three years for effective monitoring of the Eco-sensitive Zone which shall comprise of the following namely-

i) Regional Commissioner Mysore ndash Chairman

ii) Honrsquoble Member of Legislative Assembly Chamrajnagar Constituency ndash Member

iii) Honrsquoble Member of Legislative Assembly Kollegalla Constituency ndash Member

(Subject to the State Government of Karnataka obtaining relevant approvals inter alia including permission from the Speaker of Legislative Assembly Karnataka if required)

iv) Representative of the Department of Environment Government of Karnataka ndash Member

v) Representative of the Department of Urban Development Government of Karnataka ndashMember

25 Air and vehicular pollution Regulated under applicable laws

Terms of Reference

(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number SO 1533 (E) dated the 14th September 2006 and are falling in the Eco-sensitive Zone except for the prohibited activities as specified in the Table under paragraph 4 thereof shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment Forests and Climate Change for prior environmental clearances under the provisions of the said notification

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number SO 1533 (E) dated the 14th September 2006 and are falling in the Eco-sensitive Zone except for the prohibited activities as specified in the Table under paragraph 4 thereof shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities

(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act 1986 against any person who contravenes the provisions of this notification

(6) The Monitoring Committee may invite representatives or experts from concerned Departments representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV

(8) The Central Government in the Ministry of Environment Forests and Climate Change may give such directions as it deems fit to the Monitoring Committee for effective discharge of its functions

6 The Central Government and State Government may specify additional measures if any for giving effect to provisions of this notification

7 The provisions of this notification shall be subject to the orders if any passed or to be passed by the Honrsquoble Supreme Court of India or the High Court or National Green Tribunal

Boundary Description of the forest areas is as described in the Government Notifications of respective forests

North - The boundary line starts from a north eastern point on Madumalegudda Reserved Forest on Thimmarajapura village boundary of Kollegal taluk with GPS co-ordinates N 12deg7rsquo28rdquo E 77deg6rsquo5rdquo and then passes all along the northern part of Madumalegudda Revenue Forest until it reaches the northern tip of Madumalegudda Revenue Forest on Thimmarajapura village boundary From this point the line runs eastwards along Thimmarajapura village boundary till it reaches the co-ordinate N 12deg 7rsquo 40rdquo E 77deg 7rsquo 54rdquo Then the line runs along the Thimmarajapura village boundary till it reaches the bi-junction point of Thimmarajapura and Hondarabalu villages Then the line continues along the Western boundary of Hondarabalu village until it reaches the north-western tip of Hondarabalu village of Kollegal taluk

The southern portion of the entire BRT Wildlife Sanctuary forms interstate boundary between Karnataka amp Tamilnadu States Hence the Tamilnadu Forests Department authority has been requested to maintain eco-sensititive zone as per the Ministry of Environment and Forest New Delhi directions guidelines vide letter no 1-92007 WL-(Pt) dated 16-12-2013 Further all enclosures within the Reserve Forest BRT Extension Forest and Section 4 Notified areas forming BRT Wildlife Sanctuary are included as eco-sensitive zone to maintain the ecological integrity of the SanctuaryReserve
